NO PURCHASE NECESSARY TO ENTER OR WIN.  A PURCHASE DOES NOT IMPROVE YOUR CHANCES OF WINNING.  THE FOLLOWING CONTEST IS VALID IN THE UNITED STATES AND DISTRICT OF COLUMBIA (D.C.) ONLY, AND IS OPEN ONLY TO QUALIFIED PERSONS (AS DEFINED IN THE OFFICIAL RULES (“OFFICIAL RULES”) BELOW).  VOID ELSEWHERE AND WHERE PROHIBITED.  DO NOT PARTICIPATE IN THE CONTEST IF YOU DO NOT FALL WITHIN THE ELIGIBILITY REQUIREMENTS AS SET FORTH BELOW. 

 

CONTEST NAME:   New Jersey’s Get Back to Happy Video Contest (the “Contest”).

 

CONTEST DATES: Contest Registration and Video Submission Period is scheduled to begin at 12:00:00 am Eastern Time (ET) on June 20, 2013 and ends at 11:59:59 pm (ET) on July 15, 2013 (the “Registration & Video Submission Period”). Contest Judging Period is scheduled to begin at 12:00:00 am Eastern Time (ET) on July 16, 2013 and ends at 11:59:59 pm (ET) on July 21 (the “Judging Period”).  Public Voting Period is scheduled to begin at 12:00:00 am Eastern Time (ET) on July 22, 2013 and ends at 11:59:59 pm (ET) on July 31, 2013 (the “Voting Period”).  Contest is subject to all applicable federal, state and local laws and regulations.  Void outside the 50 United States and D.C. and where prohibited or restricted by law.

 

ELIGIBILITY – WHO MAY ENTER:  Contest is open only to legal residents of the states of New York, New Jersey, Pennsylvania, Connecticut, Delaware, Maryland and the District of Columbia, who are age 18 or older as of date of entry, and have a valid U.S. driver’s license or government issued identification, except the following persons who are not eligible to enter or win:

(a)   Employees, officers, and directors of Department of State, Division of Travel and Tourism (“Sponsor”); Million Dollar Media (“Contest Administrator”); Dana Communications; each of their respective franchisees, parents, affiliated companies, subsidiaries, distributors, printers, advertising and promotion agencies, and any and all other companies associated with the design or execution of this Contest (collectively, “Released Parties”), and the members of the immediate families or households, whether or not related, of any of the above. “Immediate family members” includes, for purposes of this promotion, parents (including in-laws), grandparents, siblings (including step-siblings), children (including step-children), grand children (including step grand children) and each of their respective spouses, regardless of where they reside;

(b)   Individuals who do not have access to the internet as of 6/20/2013 in order to visit NJVideoContest.com to register and upload a video submission for the Contest;

 

How to Enter – Online Registration and Video Submission:  To enter and upload your video submission, visit NJVideoContest.com during the Registration & Submission Period.  Each entrant must fully complete the online registration form with all required information, including his/her full name, complete address (including city, state and zip), valid email address, date of birth and phone number (including area code).  All entries and video submissions in the Contest become the sole property of NJ Tourism Board and will not be returned.

 

After completing the online registration, each contestant will be required to upload and submit one (1) video, that is a maximum of :10-seconds in length, as part of his/her online registration and entry.  Follow the online instructions to upload and submit your entry and video into the Contest (see video submission requirements below).  The video submission for a completed entry should include:

 

After having read and agreed to these Official Rules, submit your entry and video submission to enter the Contest.  Maximum of one (1) entry allowed per person and per valid email address per day during the entire Registration & Submission Period. 

 

All entries must include all required information, and each video submission must conform to the video submission requirements as outlined above and below, or it shall be disqualified and not considered for the contest.  Any entry or video submitted with incomplete information, an invalid email address or other inaccurate or incorrect information will be disqualified.  All registration and video submissions must be received by 11:59:59pm ET on 7/15/2013 to be eligible.

 

Released Parties are not responsible for lost, late, misdirected, incorrect, illegible, incomplete, invalid, unintelligible, or damaged entries, or for entries submitted in a manner that is not expressly allowed under these Official Rules, or for any entry not submitted or received due to any technical error or failure, human error, unauthorized human intervention, inaccurate capture or mis-entry of any required information, failures, omissions, interruptions, deletions, or defects of any phone or cellular phone provider, network computer online systems, computer equipment, servers, or software, including any injury or damage to contestant’s or any other person’s computer relating to or resulting from participation in this Contest; or the failure to capture any such information or effects of hackers or failure of any electronic equipment, computer, phone line or cellular transmissions and/or network connections; all of which will be disqualified.  

 

Each contestant must submit an entry on his/her own behalf, using video submission of him/herself.  Any other individuals included in the video, must provide entrant with express consent and permission for their images to be included and submitted in the contest, and such entrant is solely responsible for obtaining all authorizations or approvals.  The individual who completed the online entry and submitted the video shall be designated as the official contestant competing in the Contest and shall be the only individual eligible for any resulting prize award (see below).  Any entry completed and submitted on behalf of another individual or using another person’s name or email address, or use of any unauthorized video submissions will be disqualified.  No mechanically produced or automated entries permitted.  Use of any automated system to participate is prohibited and will result in disqualification and all such entries will be deemed void.  False and/or deceptive entries or acts, including misrepresentation of age, shall render such entries ineligible. 

 

In the event of a dispute as to any entry, registration or submission, the authorized account holder of the e-mail address used to register and associated with the entry will be deemed to be the registrant and s/he must be eligible according to these Official Rules. The “authorized account holder” is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address.  Proof of being the authorized account holder may be required.

 

By registering and submitting an entry and video, you affirm that you have read and accepted these Official Rules.  The laws of the United States apply to and govern this Contest and any claims must be raised and resolved in the United States.  Any information collected by registering and entering the Contest shall be used only in a manner consistent with these Official Rules and with Sponsor’s Privacy Policy. All entries and video submissions received become the sole and exclusive property of the Sponsor and will not be returned.  By entering the Contest, each contestant agrees that s/he may be contacted, recorded and/or broadcasted by Sponsor, and that his/her video submission may be used, promoted, released, broadcasted or published by Sponsor in any manner related to the promotion or advertising of the Contest. 

 

By participating and submitting an entry, contestant agrees that Sponsor and participating parties are authorized to contact contestant via email, mail, phone or any other form of media to make contestant aware of information pertinent to the Contest, and to distribute information regarding Sponsor’s featured products, offers, special events or promotional offers.  Contestants may opt-out of any further email communication at any time, without affecting their entry, by simply replying REMOVE to any email message, or following the provided opt-out instructions.  Collection and use of information collected in connection with the Contest will be in accordance with Sponsor’s Privacy Policy as posted on NJVideoContest.com.

 

General Video Submission Requirements:

Ø  Each video must be submitted in a file format accepted by the Contest website;

Ø  The submitted video submission must not exceed :10-seconds duration in total length of the video, and must comply with any file size limitations;

Ø  Each video submission entry should include:

o    Tie-in to theme: what makes you happy about summer in New Jersey

o    Creative Concept

o    Originality

Ø  Any video that is not properly submitted or received for any reason, including any technical difficulties, upload failures; failures to save or properly store the video; busy signals, or any lost or disconnected internet connections, will be disqualified. 

 

Additional Video Submission Requirements:  Sponsor reserves the right in its sole discretion, to disqualify any video submission for any reason that it considers to not be appropriate for the Contest.  Restrictions include but are not limited to: 

·         no nudity, sexually explicit or objectionable images;

·         no unauthorized videos or plagiarism of any kind;

·         no videos of any third party proprietary materials (including any third party trademarks), images or items;

·         no video that may be considered harmful to minors in any way;

·         no video that contains any political or politically themed or motivated comments, statements, or images;

·         no video that depicts or may be considered unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, pornographic, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable in any manner as solely determined by Sponsor.

 

Representation and Release of Rights to Video Submissions:  By submitting any video, each contestant represents that s/he has sole and exclusive ownership and proprietary rights of all video images submitted; has full permission of all parties within video to publish and release their images and actions shown within the video; and agrees that each video becomes the sole and exclusive property of Sponsor, and Sponsor may publish, display, promote, or utilize video in any manner of its choosing in relation to the promotion or advertising of the Contest.  Entry into the Contest and upload of any video, constitutes permission for the Sponsor and its designees to use that contestant’s video, name, city and state of residence and/or likeness for purposes of advertising and trade in any and all media now or hereafter known worldwide in perpetuity without limitation or further compensation, notification or permission, unless prohibited by law.  Video submissions will not be returned by Sponsor.

 

Sponsor reserves the right, in its sole discretion, to disqualify any individual (and all of his or her entries) who tampers or attempts to tamper with or abuse the entry process or the Contest website in any way or who is otherwise in violation of these Official Rules, as determined by Sponsor or the Contest judges appointed by Sponsor in their sole discretion.  Any questions regarding the number of entries submitted or the authorized account holder shall be determined by Sponsor in its sole discretion. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY CONTEST WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

 

Judging of Video Submissions – Determination of Semi-Finalists:  Following the close of the Registration & Submission Period, an independent panel of judges as solely determined and appointed by Sponsor shall review, select and designate a maximum of ten (10) video submissions as finalist submissions from among all eligible submissions received during the Registration and Submission Period (see judging criteria below).  The eligible contestants who submitted the selected video submissions shall be designated as Semi-Finalists, subject to verification of eligibility, and compliance with these Official Rules.  Only the ten (10) contestants whose video submissions are selected by the judges shall be eligible to win the grand prize. All other entries and video submissions will be disqualified.

 

Video submissions shall be judged by a Sponsor-appointed independent panel pursuant to the following general guidelines, requirements and criteria in the determination of the winning video submission.  Each of the following categories shall represent a one fourth total of the total score per below:

o    50% tie-in to theme: what makes you happy about summer in New Jersey

o    25% creative concept

o    25% originality

 

Public Voting Period:  In order to submit your vote(s) during the Contest, visit NJVideoContest.com (“Contest Site”) between the “Public Voting Period” and follow the on-line instructions.  Each entrant must fully complete the registration page with all required information including their complete name, address (including city, state and zip), phone number (including area code), valid email address, birth date and gender.  After registering, each entrant will use their registered email address, to log in to the Contest Site during the Public Voting Period to submit votes.  After having read and agreed to these Official Rules, click the submit button to submit your registration.  Any entry submitted with an invalid email address will be disqualified. 

 

In the event of a dispute as to any on-line registration, the authorized account holder of the e-mail address used to register will be deemed to be the registrant and he/she must be eligible according to these Official Rules.  The “authorized email account holder” is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address.  Proof of being the authorized account holder may be required.

 

Sponsor and Administrator reserve the right, in their sole discretion, to disqualify any individual (and all of his or her entries) who tampers or attempts to tamper with the entry process or Contest website in any way or who is otherwise in violation of these Official Rules, as determined by Sponsor and/or Administrator. Any questions regarding the number of entries submitted or the authorized account holder of an email address shall be determined by Sponsor and/or Administrator in their sole discretion. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY PROMOTION WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

 

Submitting Votes:  After completing the registration page, visit the voting page of the Contest Site, select one (1) of the ten (10) available videos and submit your vote. 

 

Limit:  One (1) vote/entry per day per registered entrant during the Contest Period.

 

The Released Parties are not responsible for lost, late, misdirected, illegible, incomplete, invalid, unintelligible, or damaged entries, or for entries submitted in a manner that is not expressly allowed under these Official Rules, or for any entry not submitted or received due to any technical error or failure, unauthorized human intervention, inaccurate capture or mis-entry of any required information, or the failure to capture any such information or effects of hackers or failure of any electronic equipment, computer or cellular transmissions and/or network connections; all of which will be disqualified.

 

The Released Parties are not responsible for any difficulty in viewing any videos, or delays in the posting of any videos during the Public Voting Period.

 

Each entrant must submit an entry on his/her own behalf.  Any entry submitted on behalf of another individual or using another person’s email address or name will be disqualified and ineligible to claim any prize.  No mechanically reproduced or automated entries permitted.  Use of any automated system to participate is prohibited and will result in disqualification and all such entries will be deemed void. 

 

Determining Grand Prize Finalist and Runner-up:  At the conclusion of the Public Voting Period, the Contest Administrator shall determine which semi-finalist received the highest vote total during the Public Voting Period and designate them as the selected grand prize finalist, and which semi-finalist received the second highest vote total during the Public Voting Period and designate them as the runner-up.  In the event of a tie between (2) or more semi-finalists, Contest Administrator shall conduct a random drawing to determine the grand prize finalist and/or runner-up.  Only the (1) selected grand prize finalist shall be eligible to participate in the grand prize contest, or win the grand prize.  All other entries are disqualified, and ineligible to claim any prize.  Finalist selection is non-transferable. 

 

Grand Prize Finalist Notification:  The potential grand prize finalist will be notified by phone at the number provided on their online registration form.   Messages will not be left during the notification process.  If after two attempts over a 48 hour period at the number listed on the registration form, Contest Administrator is unable to reach and speak directly with the potential finalist, then that finalist will be disqualified and is not eligible to participate in the contest or win any prize.  Contest Administrator shall then determine which Semi-Finalist received the second highest vote total during the Public Voting Period and designate them as the selected grand prize finalist, and will notify the selected finalist per the procedures outlined above. This process will continue until a grand prize finalist is determined.

 

In order to participate in the grand prize finalist, the selected grand prize finalist will be required to be present at the date, time and location as specified by the Contest Administrator on the notification call to participate in the grand prize contest attempt.  If the selected grand prize finalist does not meet the eligibility requirements or is unwilling to attend the event, or does not wish to participate in the grand prize contest, then that finalist will be disqualified and an alternate finalist will be selected per the procedures listed above, time permitting.  A disqualified grand prize finalist will not receive any alternate prize award or compensation. Difficulties with getting to location to participate in the contest are not the responsibility of Sponsor.  If the selected finalist fails to appear at the required date, time and location, they will be disqualified from the contest.  Sponsor reserves the right in its sole discretion to change the date, time or location of the grand prize contest.  Selected finalist will be notified of any changes at the time of their selection and/or notification.  Decisions of judges in the selection of finalist, and all matters related to this contest are final.

 

Grand Prize Money Bag Pick Contest:  In order for a grand prize to be awarded to the (1) eligible Grand Prize Finalist, the finalist must select the (1) money bag from the set of (150) money bags provided for their contest attempt that contains the official “Grand Prize Winning Certificate”. 

 

The following will apply to the grand prize contest attempt:

·         The contest attempt must occur in the presence of the contest administrator.  Any attempt not made in the presence of the contest administrator for any reason will be disqualified and is not eligible for the grand prize.

·         The eligible finalist will be presented with (150) money bags, each containing one sealed contest envelope which is identical in size, shape, and color. 

·         Each of the sealed contest envelopes will be labeled with a number to encompass the entire range of numbers from 1 to 150.  No two contest envelopes will be printed with the same number within the set of (150) contest envelopes.

·         The eligible finalist will be required to select a maximum of (1) money bag and remove the sealed contest envelope contained inside.  In the event any money bag contains more than one (1) sealed contest envelope – the finalist will be required to select only one of the envelopes.

·         The eligible finalist will then open and remove the prize certificate contained inside the contest envelope.  Opening more than (1) sealed contest envelope for any reason will disqualify the contestant, and void any opportunity to claim the grand prize.

·         The eligible finalist will reveal the enclosed prize certificate to the contest administrator to determine if the certificate
       is a “Winning” or “Non-Winning” prize certificate.

 

In order to claim the grand prize, the (1) sealed contest envelope selected and opened by an eligible finalist must contain the “Grand Prize Winning” certificate.  The winning symbol printed on the grand prize winning certificates for this contest will be (Grand Prize – New Car).  The “Non-Winning” prize certificates will be printed with “Sorry – Not a Grand Prize Winner” or other similar text clearly distinguishing it as a “Non-Winning” certificate.  In the event that an eligible finalist does not select the (1) money bag inserted with prize envelope that contains the grand prize winning certificate, then the grand prize will not be awarded. 

 

IMPORTANT:  In the event of an error in the preparation of the contest materials or any tampering that results in the set of (150) sealed contest envelopes containing more than (1) “Winning Prize Certificate”, that particular contestant attempt is void.  The corresponding contestant will entitled only to re-attempt the contest, and will be provided a new set of sealed contest envelopes for their re-attempt.

 

Prize Awards & Delivery: 

 

Runner-up Guaranteed Prize Package:  The semi-finalist who is designated as the runner-up winner will be awarded a trip for two (2) (winner and one (1) guest) to Cape May, New Jersey with an approximate retail value not to exceed $1,000.00.  The trip includes:

·         Three (3) night hotel accommodations for (2) at the Bacchus Inn in Cape May, New Jersey

·         (1) $100 gift certificate to the Mad Batter Restaurant 

·         (2) tickets to Historic Cold Spring Village

·         (2) tickets to Cape May Light House

·         (2) tickets to Emlen Physick Estate Tour

·         (2) tickets to Historic District Trolley Tour

 

Grand Prize Finalist Guaranteed Prize Package:  The semi-finalist who is designated as the grand prize finalist will be awarded a trip for two (2) (winner and one (1) guest) to Cape May, New Jersey with an approximate retail value not to exceed $1,000.00.  The trip includes:

·         Three (3) night hotel accommodations for (2) at the Albert Steve Inn in Cape May, New Jersey

·         (1) $100 gift certificate to the Mad Batter Restaurant 

·         (2) tickets to Historic Cold Spring Village

·         (2) tickets to Cape May Light House

·         (2) tickets to Emlen Physick Estate Tour

·         (2) tickets to Historic District Trolley Tour

 

All travel arrangements require a minimum of 30-days advance request, are based solely upon availability, and must be completed by 5/30/2015, or prize award is forfeited.  Certain blackout dates apply.  Sponsor is not responsible for any travel delays or difficulty.  If travel delays or difficulty prevent arrival in time for any and all elements of trip, Sponsor is not responsible for awarding any compensation in lieu thereof.  Each winner and his/her guest must travel together on the same itinerary.  Any changes to completed travel arrangements, once booked, are the sole responsibility of the winner, and are solely at the winner’s expense. 

 

Unless child of winner, Grand Prize winner’s guest must be of legal age of majority in his/her state of residence (and at least 18) and will be required to execute and return a liability/publicity release prior to prize award.   Tickets are subject to certain terms and conditions specified thereon.  All transportation, meals, gratuities, applicable taxes (including, but not limited to all local, state and federal taxes) and any other expenses not specified herein as being included in the Grand Prize are the sole responsibility of the winners

 

Grand Prize: In the event the eligible finalist successfully completes the Grand Prize Money Bag Pick contest, that finalist will be eligible to claim the grand prize, subject to approval and verification of compliance with these Official Rules.  The grand prize for this contest is: a 2013 convertible vehicle with an MSRP not to exceed $60,000.

  

Winner must accept delivery of vehicle from the sponsor designated dealer, or as otherwise specified by Sponsor.  Administrator will solely designate and specify available vehicle including make, model, color and options for Grand Prize winner’s prize award.  Grand Prize winner may not substitute, exchange, or apply the vehicle’s value towards a higher cost or alternate vehicle.  Designated vehicle must be the Sponsor designated vehicle that is currently in designated dealer’s stock of inventory.  Administrator reserves the right to award an alternate year model (i.e. 2012), if the 2013 model is not available at the time of prize award. 

 

If the designated prize vehicle MSRP is under $60,000, the winner will not be awarded the difference between the vehicle’s actual MSRP and $60,000.  Grand Prize winner is responsible for paying sales tax on prize award at time of delivery, estimated at approximately $4,200 (based on a 7.0% tax value) but may vary depending on the county in which the vehicle is awarded. 

 

Prize winner(s), if any, must accept delivery of prize from sponsor, or as otherwise instructed by sponsor.  All costs related to prize delivery and acceptance is the responsibility of winner including but not limited to federal, state and local taxes, insurance and fees.  All properly claimed prizes will be awarded.  Prizes are non-transferable and no cash redemption or prize substitution allowed, except at sponsor’s sole discretion or as provided herein.  All prize winner(s) will be required to complete and return a W-9 form (if prize value exceeds $600.00), affidavit of eligibility, and liability/publicity release (Tennessee residents need not sign publicity release), and present a valid driver’s license and social security card before prize will be awarded.  Winners of prizes greater than $600.00 will be issued a 1099 form reflecting the value of the prize(s) and are responsible for paying all taxes on prize(s).  Failure to collect or properly claim any prize in accordance with these rules will result in forfeiture of prize.  If forfeited for any reason, contestant will not receive any other prize substitution or compensation.  Maximum Value of all prize awards available: $62,000.00

 

Additional Rules & Restrictions:  By participating in this Contest, contestants agree to abide by and be bound by the Official Rules and decisions of Sponsor and Administrator, which shall be final in all matters relating to this Contest.  In the event a contestant wins a prize, and is later found to be in violation of these Official Rules s/he will be required to forfeit the prize or to reimburse Sponsor for the stated value of the prize if such violation is discovered after winner has used the prize. Entry into Contest constitutes permission for the Sponsor and its designees to use contestants’ names, cities and states of residence and/or likenesses for purposes of advertising and trade in any and all media now or hereafter known worldwide in perpetuity without limitation or further compensation, notification or permission, unless prohibited by law.  False, fraudulent or deceptive entries or acts shall render contestants ineligible for any prize.

 

By entering the Contest, contestants agree to hold all Released Parties harmless from any claims, losses, actions, or damages of any kind, whether actual, incidental or consequential, for injury (including but not limited to death), damages, losses or expenses arising out of or relating to contestant’s participation in this Contest, or the acceptance, possession or use/misuse of any prize, or participation in prize-related activities (including but not limited to travel or activity related thereto), and to assume all liability therefor. 

 

In addition, by submitting any video, each contestant transfers any and all of his/her right, title and interest in and to such video, including but not limited to any and all copyrights, trademark rights, "moral rights" and any and all other proprietary rights that may exist, throughout the world, to Sponsor and expressly waives any rights s/he may have in such submission. Each contestant agrees Sponsor is the exclusive owner of all rights in and to such video submission, and will have the worldwide, perpetual right to copy, display, reproduce, exhibit, edit, modify, assign, license, register for copyright or trademark, distribute, sell or otherwise use and exploit the video submission and all elements and/or derivative works thereof, in whole or in part, alone or with other materials, in any media now known or hereafter created or devised, for any reason whatsoever.

 

Released Parties shall not be liable to any winner or any other person for failure to supply the prize or any part thereof by reason of any acts of God, any actions, regulations, orders, or requests by any governmental entity, equipment failure, terrorist acts, war, fire, unusually severe weather, embargo, labor dispute or strike, labor or material shortage, transportation interruption of any kind, or any other cause beyond Released Parties’ sole control. 

 

Sponsor reserves the right to cancel, modify or terminate the Contest if fraud, misconduct or technical failures destroy or threaten the integrity of the Contest, in the opinion of the Sponsor or Administrator, or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper conduct of the Contest as determined by Sponsor or Administrator, in its sole discretion. In the event of early termination of the Contest, Sponsor reserves the right to select Grand Prize Winner from among all eligible, non-suspect entries received as of the time/date of such termination.

 

IN CASE OF DISPUTES:  By entering, each contestant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of New Jersey; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, and in no event will contestant be entitled to received attorneys' fees or other legal costs; and (3) under no circumstances will contestant be permitted to obtain awards for, and contestant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of contestant and Sponsor in connection with this Contest, shall be governed by, and construed in accordance with the laws of the State of State of New Jersey, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of State of New Jersey or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of New Jersey.
