NOTE: All contest entries are submitted on behalf of the eligible designated Public School nominated on the entry. There are no prize awards available for individual entrants in the Contest. Contest is open only to public schools, grades K – 12, located in the following states: Connecticut, Maine, Massachusetts, New Hampshire, Rhode Island, and Vermont. Private schools and other facilities are not eligible to be nominated or win in this contest.
Contest Name: NorthEast Electrical Distributors Project Green Lights 2016 (the “Contest”).
Contest Dates: Contest registration will begin at 12:00am ET on 9/19/2016 and end at 11:59pm ET on 11/30/2016 (the “Contest Registration Period”). The Contest is subject to all applicable federal, state and local laws and regulations and is void wherever prohibited or restricted by law.
Who may Enter: Contest is open ONLY to eligible Public Schools, grades K – 12, that are located within CT, ME, MA, NH, RI, and VT. Nominations for eligible public schools in the contest may only be submitted by an Authorized School Official (an “Authorized Representative”) of the school being nominated, which may include without limitation: school superintendents, school principals, school district representatives, or any other school representative that has received express authorization and approval from their Authorized School Official to nominate their school.
Authorized Representatives may nominate more than one school within their jurisdiction but each nominated school must be a separate entry in this contest. Maximum of one (1) nomination per school during the entire Contest Registration Period will be accepted. If more than one nomination is received for a particular school (from the same entrant or different entrants), only the first completed eligible entry received chronologically from an Authorized Representative will be entered into the contest. In no event may an entire school district or group of schools be nominated on a single entry submission. To be a valid entry in this contest, the entry form must specifically identify the one (1) specific public school by name (grades K – 12) being nominated by that entry.
How to Enter – Online Nomination and Entry Submission: Visit www.ProjectGreenLights.com during the “Contest Registration Period”, and click on the ‘Contest’ page link. The Authorized Representative must fully complete the registration page with all required information including their own name, email address, and title; and the nominated public school name (grades K – 12), school address (including city, state, zip), and school phone number. Each entrant must also provide a short essay (preferably 250 words or less), describing why they feel their nominated public school should be the 2016 recipient of the NorthEast Electrical Distributors Project Green Lights Sylvania $50,000 lighting and electrical makeover (see grand prize details below).
All essays submissions received become the sole and exclusive property of the Sponsor and will not be returned. By entering the Contest, each contestant agrees that s/he may be contacted, recorded and/or broadcast by Sponsor, and that his/her essay submission may be used, promoted, released, broadcast or published by Sponsor in any manner related to the promotion or advertising of the Contest and/or the Sponsor. Any essays containing any disparaging, vulgar, inflammatory or otherwise inappropriate content as solely determined by Sponsor shall be disqualified.
By submitting an essay, entrants affirm that the entry is original and does not contain any copyrighted or plagiarized material and agree that Sponsors may (but are not obligated to) read any entry submitted on the air, publish in any form of media, or post it on its website (in whole or in part, edited or unedited) and use entries and essays as the subject of commentary, humorous or otherwise. By entering this contest, entrants waive any right to make any claim against Sponsors with respect to any disparaging or other comment made on-air about such entrant’s entry and hereby agrees to indemnify and hold Sponsors and Released Parties harmless from any and all claims, demands, complaints, loss, damage or expenses (including without limitation reasonable attorneys’ fees) resulting from the information/content contained in each entrant’s entry about themselves, their school or town or any other person mentioned or referenced therein (including, without limitation, if the information/content is communicated by Sponsor verbatim or in any paraphrased form). In no event does Sponsor intend to verify whether or not the information provided in the essay is accurate or not.
Sponsor reserves the right to (but the obligation) to post some or all of the entry information and/or essays on the Contest website, in whole or in an edited form (in Sponsor’s discretion). Having your essay/entry posted does NOT mean that your nominated school has won or is likely to win this contest. The decision to post any entries/essays is for entertainment and informational purposes only and is not part of the winner selection process in this contest.
IT IS THE SOLE RESPONSIBILITY OF ALL ENTRANTS TO CHECK IN ADVANCE WITH THE APPROPRIATE SCHOOL AUTHORITY TO DETERMINE WHETHER OR NOT THE SCHOOL WISHES TO BE NOMINATED, AND WHETHER THE NOMINATED SCHOOL INTENDS TO ACCEPT THE PRIZE IN THE EVENT OF WINNING.
After having read and agreed to these Official Rules, click the submit button to submit your entry. All entries received must be fully complete for all required information. Any entry submitted with an invalid email address or other incomplete or inaccurate information will be disqualified. Maximum of one entry per nominated school. All entries must be received by 11:59pm ET on 11/30/2016 to be eligible.
Any available opt-in opportunities are not required to submit your entry in the Contest, and checking the opt-in boxes will not improve your nominated school’s chances of winning. By participating and submitting an entry, contestant agrees that sponsors and participating parties are authorized to contact entrant or nominated school via email, mail, phone or any other form of media to make contestant aware of information pertinent to the contest, and to distribute information regarding the Sponsor(s) featured products, special events or promotional offers, or incentives. Contestants may opt-out of any further email communication at any time by simply replying REMOVE to any email message, or following the provided opt-out instructions.
Any incomplete or illegible entries will be disqualified. Released Parties are not responsible for lost, late, misdirected, illegible, incomplete, invalid, unintelligible, damaged, or for entries submitted in a manner that is not expressly allowed under these rules, or for any entry not submitted or received due to any technical error or failure, unauthorized human intervention, inaccurate capture or mis-entry of any required information, or the failure to capture any such information or effects of hackers or failure of any electronic equipment, computer or cellular transmissions and/or network connections; all of which will be disqualified.
No mechanically reproduced or automated entries permitted. Use of any automated system to participate is prohibited and will result in disqualification and all such entries will be deemed void. By submitting an entry, participants agree to be bound by & abide by the official rules of the Contest. All entries received become the property of the Sponsor and will not be returned.
Winner Selection & Notification: On or about 12/7/2016, one (1) potential grand prize winning school shall be determined from among all eligible entries (nominations/essays) submitted:
Decisions of the Sponsor, Administrator and judges in the selection and determination of semi-finalists and the grand prize winning School and all matters relating to this Contest are final and binding. The authorized representative of the potential grand prize winning school will be notified initially by phone beginning on or about 12/12/2016. If the Administrator is unsuccessful in its attempt to reach and speak directly with the authorized representative of the selected school by phone after three (3) attempts over a 72-hour period to the phone number listed for that nominated school, then that school may be disqualified and an alternate potential grand prize winning school may be determined based upon the next highest vote total from the remaining entries per the procedures outlined above. Note: messages may or may not be left during the winning school notification process.
During the notification phone call to the grand prize winning school, the authorized representative of the grand prize winning school must confirm their school’s eligibility, and indicate their willingness to accept the prize on behalf of the school. The authorized representative of the potential grand prize winning school will then receive official notification via email, and/or certified or overnight mail delivery.
If the selected school does not meet the eligibility requirements or the authorized representative elects to decline the prize, that school will be disqualified and, at Sponsor’s discretion and time permitting, an alternate winning school will be selected from among all remaining eligible entries and notified as per the procedures outlined above, time permitting. Any disqualified school will not receive any alternate prize substitution or compensation.
All of the following will apply to the grand prize winning school: 1) The authorized representative will be required to complete and return, within 3 days of date of receipt, a prize acceptance form, a W-9 form, an affidavit of eligibility, and a liability/publicity release (where permitted); 2) Winning School may be issued an IRS Form 1099 reflecting the actual value of all prizes won; and 3) Winning school will be responsible for paying all applicable taxes (including, but not limited to all local, state and federal taxes) on all prizes awarded. Failure to collect or properly claim any prize in accordance with these rules will result in forfeiture of the prize. If forfeited for any reason, school will not receive any other prize substitution or compensation, and the prize will remain the property of Sponsor and will not be awarded, except as provided herein.
The School representatives signing the documents may be asked to provide proof of authority at the request of the Sponsor prior to the awarding of any prize. No school will be deemed a winner in this contest until the foregoing have been completed in a timely manner. In the event that Sponsor does not receive any eligible entries, Sponsor will not award the grand prize.
Grand Prize – Maximum of (1) grand prize award available: The grand prize winning school as selected and designated by Sponsor, will be awarded the grand prize award as follows:
· An Energy Audit by NorthEast Electrical and up to $50,000 in Sylvania Energy Efficiency Lighting products courtesy of NorthEast Electrical Distributors per the outline and details below.
In order to give the winning school a thorough understanding/educated opinion of the best operational, financial and environmental improvements needed, NorthEast Electrical Distributors and Sylvania will provide a Lighting Energy Audit that will recommend an appropriate energy savings solution including lamps and ballasts. Other energy savings and/or green recommendations may be made but the only materials/installations that are included in this prize are as described in Sections (a) and (b) below. The completion of this audit is a condition of receiving the prizes described in Sections (a) and (b) below. The school representative who signs the Release Agreement will be contacted within 30 days after the full execution and return of that release agreement in order to schedule this audit. The audit will occur on a mutually agreed upon day and time but in no event later than March 31, 2017. A written audit report will be delivered to the school within approximately 30 days after completion the on-site audit is conducted.
a. The school will be provided with energy efficient lamps and ballasts in order to achieve the maximum energy savings impact, up to a maximum value not to exceed $50,000, in accordance with the audit report.
b. Only products from Sylvania’s Energy Efficiency Catalog will be installed. School may select the lamp and ballast options available to it by viewing the Sylvania Energy Efficiency Catalog options as provided and designated by Sponsor (http://www.sylvania.com/BusinessProducts/LightingForBusiness/ Products/Energy EfficientProducts/default.htm). The determination of the number of lamps and ballasts that will be awarded to the School will be dependent upon the recommendations made in the audit report.
c. The lighting system will be installed by NorthEast Electrical Distributors on a day and time mutually agreeable to the applicable school official and NorthEast Electrical Distributors.
d. This prize, once installed, is provided “as is” and Sponsor has not made, will not make and is not responsible in any manner for any warranties, representations or guarantees, express or implied, in fact or in law, relating to the lightening products or their installation, including without limitation, their quality, mechanical condition, merchantability, or fitness for a particular purpose, with the exception of any standard manufacturer’s warranty that may apply to the lighting products. In all events, NorthEast Electrical Distributors will use commercially reasonable efforts to have all products selected by the School (in accordance with the audit report) installed on or before August 30, 2017.
Total value of the grand prize will depend on the precise products recommended, selected and installed but in no event will exceed $50,000, including installation costs. All prize awards are non-transferable and no cash redemption or prize substitution allowed, except at Sponsor’s sole discretion or as provided herein. All federal, state and local taxes are the winning school’s sole responsibility. Sponsor reserves the right to substitute a prize of comparable or greater value, at its sole discretion. Failure to collect or properly claim prize in accordance with these rules will result in forfeiture of the prize. All properly claimed prizes will be awarded. Any unclaimed prizes will not be awarded. Maximum retail value of prize awards: $50,000.
Additional Rules & Restrictions: By participating, entrants agree to abide by and be bound by the Official Rules and the decisions of the Sponsor and Administrator, which shall be final in all matters relating to this Contest. In the event a nominated school wins the prize, and is later found to be ineligible or the nominator was in violation of these rules the school will be required to forfeit the prize or to reimburse Sponsor for the stated value of the prize if such violation is discovered after school has used the prize. Participation in Contest constitutes permission for the Sponsor and its designees to use entrants’ and nominated schools’ names, cities and states of residence and/or likenesses for purposes of advertising and trade in any and all media now or hereafter known worldwide on perpetuity without limitation or further compensation, notification or permission, unless prohibited by law. False, fraudulent or deceptive entries or acts shall render entrants ineligible for any prize.
By participating, entrants agree to hold all Released Parties harmless from any claims, losses, actions, or damages of any kind, whether actual, incidental or consequential, for injury (including but not limited to death), damages, losses or expenses arising out of or relating to entrant’s participation in this Contest, or the acceptance, possession or use/misuse of any prize, or participation in prize-related activities (including but not limited to travel or activity related thereto), and to assume all liability therefor.
Released Parties shall not be liable to winner or any other person for failure to supply the prize or any part thereof by reason of any acts of God, any actions, regulations, orders, or requests by any governmental entity, equipment failure, terrorist acts, war, fire, unusually severe weather, embargo, labor dispute or strike, labor or material shortage, transportation interruption of any kind, or any other cause beyond Released Parties’ sole control.
Participants are restricted to use of ordinary and typical computer equipment, mobile phone equipment, Internet access and cellular networks. Sponsor disclaims all liability for the inability of a participant to complete or continue an entry due to equipment malfunction, busy lines, inadvertent disconnections, acts beyond the Sponsor’s control, or otherwise. The Sponsor disclaims any liability for entries not received due to technical difficulties or transmission errors. The Sponsor disclaims all liability for any delays, mis-delivery, loss, or failure in the delivery of any item sent by mail, courier, express, electronic transmission, or other delivery method. Released Parties are not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including: failed, incomplete, garbled or delayed transmission of online entries, traffic congestion on telephone lines, the Internet or at any website or lost or unavailable network connections which may limit an online entrant's ability to participate in the Contest, and any injury or damage to entrant’s or any other person’s computer or mobile phone related to or resulting from participating in or downloading any information necessary to participate in the Contest.
Released Parties are not responsible for any other errors of any kind, whether computer, technical, typographical, printing, human or otherwise, relating to or in connection with the Contest, including, without limitations, errors which may occur in connection with the printing or advertising of this Contest, administration or execution of the Contest, the cancellation of any game or event, the processing of entries or in the announcement of the prizes or prize winners. Sponsor, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of the Contest website.
Sponsor reserves the right to cancel, modify or terminate the Contest if fraud, misconduct or technical failures destroy or threaten the integrity of this portion of the Promotion, in the opinion of the Sponsor/Administrator, or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper conduct of the Contest as determined by Sponsor/Administrator, in their sole discretion. In the event of early termination of the Contest, Sponsor reserves the right to determine winner in a drawing from among all eligible, non-suspect entries received as of the time/date of such termination.
IN CASE OF DISPUTES: By participating, each entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with this Promotion, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of Massachusetts; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, and in no event will entrant be entitled to received attorneys' fees or other legal costs; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with this Promotion, shall be governed by, and construed in accordance with the laws of the State of Massachusetts, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Massachusetts or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of Massachusetts.
Odds: Odds of being selected as a semi-finalist school are based upon the total number of eligible entries/nominations received, and the decisions of judges. The odds of a semi-finalist school winning the grand prize, once selected as a semi-finalist school, are based upon the number of selected semi-finalist qualifiers, the quality of the submitted essay and the opinion and decisions of the judges.
