STATES AND THE DISTRICT OF COLUMBIA, AND IS OPEN ONLY TO QUALIFIED PERSONS AGE 13
OR OLDER (AS DEFINED IN THE RULES BELOW).
VOID ELSEWHERE AND WHEREVER PROHIBITED.
DO NOT PARTICIPATE IN THE CONTEST IF YOU DO NOT FALL WITHIN THE
ELIGIBILITY REQUIREMENTS AS SET FORTH BELOW.
THIS CONTEST MAY BE
CANCELED OR POSTPONED BY SPONSOR, IN FULL OR IN PART, AT ANY TIME, INCLUDING
FOR REASONS DUE TO THE ONGOING PANDEMIC (E.G., CORONAVIRUS/COVID-19).
Contest
Name: Big League Bubble Battle (the “Contest”).
Contest Dates: The Contest is scheduled to begin at
12:00:00 am Eastern Time (ET) on 6/14/2021 and ends at 11:59:59 pm (ET) on 7/25/2021
(the “Entry Period”). The administrator’s computer is the Contest official
clock.
Who
May Enter:
Contest is open only to legal residents of the forty-eight (48)
contiguous United States and the District of Columbia, who are age 13 or older as of date of entry (entrants 18 or
older must have a valid U.S. driver’s license or government issued ID)
(each an “Entrant”), except the following persons who are not eligible to
enter, participate or win:
a) Employees, officers,
and directors of Ford Gum & Machine Company (“Sponsor”), Million Dollar
Media (the “Administrator”), each of the foregoing’s respective franchisees,
owners, employees, contractors, parents, affiliated companies, subsidiaries,
distributors, retailers, wholesalers, printers, advertising and promotion agencies,
and any and all other companies associated with the design or execution of this
Contest (collectively, “Released Parties”), and the members of the immediate
families or households, whether or not related, of any of the above are not
eligible to participate or win. “Immediate family members” includes, for
purposes of this promotion, parents (including in-laws), grandparents, siblings
(including step-siblings), children (including step-children), grand children
(including step grandchildren) and each of their respective spouses, regardless
of where they reside.
NOTE: Individuals
age 13 to 17 may be eligible to participate in Contest with the approval of a
parent or legal guardian, provided that the parent or legal guardian is a legal
U.S. resident at least 18 years of age at the time of entry with a valid U.S.
driver’s license or government issued ID, and resides within the forty-eight (48) contiguous
U.S. and D.C. In the event of a winning submission, a Parent/legal
guardian will be required to accept prize on behalf of Entrant (and assume
all tax liability associated with accepting prize), and must be one of the
travelers, and must attend all activities/trip with minor.
How to Enter – Photo
Submission (each an “Entry”): Create an original photo of yourself blowing a bubble. Then snap a photo that includes yourself and your
bubble creation (each a “Photo”) and upload or post the Photo to enter the Contest
during the Entry Period in any of the three (3) entry methods outlined
below. (Note: There is no purchase or
representation of Big League Chew© required to participate. Participants may
use any bubble gum or other method to demonstrate blowing a bubble).
Each Entry requires a unique bubble
creation and Photo that has not previously been entered in the Contest. Each participant must submit an Entry on
his/her own behalf. Any Entry submitted
on behalf of another individual or using another person’s name, email address
or Photo, or providing any false email addresses or information, will be
disqualified and ineligible to claim any prize.
Any attempt by any participant to obtain more than the stated number of Entries
allowed by using same, multiple/different emails, identities, or any other
methods void that participant's Entries and that participant may be
disqualified. No
mechanically produced, digitally altered, digitally enhanced or automated Entries
permitted. Use of any automated system to participate is prohibited and will
result in disqualification and all such Entries will be deemed void. False and/or deceptive Entries or acts,
including misrepresentation of age, shall render such entries ineligible.
All
Photos and Entries in the Contest become the sole property of Sponsor and will
not be returned. Each Entrant agrees
that their submitted Photo Entry and comments may be viewed by the public. Sponsor reserves the right to disqualify and
remove any Photo Entry at any time that is not in compliance with these
Official Rules. All Photo Entries must
conform to the Photo submission requirements as outlined above and below, or it
may be disqualified and not considered for the contest.
Any
other individuals included in the Photo Entry, must provide Entrant with
express consent and permission for their images to be included and submitted in
the Contest, and such Entrant is solely responsible for obtaining all authorizations
or approvals. The individual who
submitted the Photo Entry shall be designated as the official Entrant competing
in the Contest, regardless of any other individuals included in the Photo
Entry, and shall be the only individual eligible for any resulting prize award
(see below). Any Photo Entry completed
and submitted on behalf of another individual or using another person’s name,
email address, or Instagram/Twitter account; or use of any unauthorized photo
submissions will be disqualified.
By participating and submitting an Entry,
contestant agrees that Sponsor and participating parties are authorized to
contact Entrant via email, mail, phone or any other form of media to make
contestant aware of information pertinent to the Contest, and to distribute
information regarding the Sponsor(s) featured products, discounts, special
events or promotional offers. Contestants
may opt-out of any further email communication at any time by simply replying
REMOVE to any email message, or following the provided opt-out instructions. Any available opt-in opportunities are not required
to enter the Contest, and checking the opt-in boxes will not improve your
chances of winning.
All
Entries must include all required information.
Any Entry or Photo submission with incorrect, incomplete
or illegible information, an invalid email address or other inaccurate
information will be disqualified. Released Parties are not responsible for
lost, late, misdirected, incorrect, illegible, incomplete, invalid,
unintelligible, or damaged Entries, or for entries submitted in a manner that
is not expressly allowed under these Official Rules, or for any entry not
submitted or received due to any technical error or failure, human error,
unauthorized human intervention, inaccurate capture or mis-entry of any
required information, failures, omissions, interruptions, deletions, or defects
of any phone or cellular phone provider, network computer online systems,
computer equipment, servers, or software, including any injury or damage to contestant’s
or any other person’s computer relating to or resulting from participation in
this Contest; or the failure to capture any such information or effects of
hackers or failure of any electronic equipment, computer, phone line or
cellular transmissions and/or network connections; all of which will be
disqualified.
In the event
of a dispute as to any Entry, registration or submission, the authorized
account holder of the email address, Instagram or Twitter account used to
register or post the Photo, and associated with the Entry will be deemed to be
the registrant and s/he must be eligible according to these Official Rules. The
“authorized account holder” is the natural person assigned an email address by
an Internet access provider, online service provider or other organization responsible
for assigning email addresses for the domain associated with the submitted
address or the assigned Instagram or Twitter account holder of the account name
used to post the Photo. Proof of being
the authorized account holder may be required.
By registering and
submitting an entry and Photo, you affirm that you have read and accepted these
Official Rules. The laws of the United States apply to
and govern this Contest and any claims must be raised and resolved in the
United States. Any information collected
by registering and entering the Contest shall be used only in a manner
consistent with these Official Rules and with Sponsor’s Privacy Policy. By
entering the Contest, each contestant agrees that s/he may be contacted,
recorded and/or broadcasted by Sponsor, and that his/her Photo submission may
be used, promoted, released, broadcasted or published by Sponsor in any manner
related to the promotion or advertising of the Contest.
General Photo Submission Requirements:
Ø Each Photo must be submitted in a file
format accepted by Instagram, Twitter or the Contest Website (i.e. Instagram
App, JPG, PNG, etc.);
Ø
Must
be the Entrant’s own original Photo and have not been previously entered into this
Contest or any other Contest or Contest by the Entrant or any other person (i.e.
if you enter a Photo on Instagram during the Entry Period, that same Photo may
not be used by you or anyone else to enter again on Instagram, Twitter or the Contest
Website.)
Ø Any Photo that is not properly submitted
or received for any reason, including any technical difficulties, upload
failures; failures to save or properly store the Photo; busy signals, efforts
of hackers; or any lost or disconnected internet connections, will be
disqualified.
Additional Qualifying
Photo Requirements: Sponsor reserves the right in its sole
discretion, to disqualify any Entry and Photo for any reason that it considers
to not be appropriate for the Contest. Restrictions
for Photos and/or any related comments about the Photo include, but are not
limited to, the following requirements in that the Entry must:

include
the Entrant as either a single participant or one of multiple participants blowing
a bubble;
·
not
be, or ever have been, submitted in any competition, Contest or Sweepstakes of
any kind;
·
not
use any name, likeness, or any other identifying element, in whole or in part,
of any person, living or dead, without permission;
·
not
be digitally enhanced or altered beyond
standard optimization (permitted standard optimization includes red eye removal, removal of dust,
cropping, reasonable adjustments to exposure, color and contrast, etc.);not
be subject to any third-party agreement or require payment or incurrence of any
sums to obtain further permissions of any person or entity as a result of its
use or exploitation of the idea or rights therein or portions, or modified
versions or derivative works thereof;
·
except
as relates to the Sponsor brands or approved partners, not include trademarks,
logos, or copyrighted material not owned by Entrant or material that is used
without permission (including but not limited to company names, photographs,
works of art, or images published on any media) or that otherwise infringes or
violates the rights of any third party (including but not limited to,
copyrights, trademarks, patents, trade secrets, logos, contract and licensing
rights, rights of publicity or privacy, moral rights (i.e., “droit morale”), or
any other intellectual property rights);
·
not
feature any minor age of 13 or older unless the minor has their parent or legal
guardian’s permission to be included in the Photo;
·
not
feature any minor under the age of 13 unless the minor under the age or 13 is accompanied
by their parent or legal guardian in the Photo;
·
not
feature, refer to, or mention any companies or brands other than Sponsor or
Sponsor’s brands;
·
not
include any unauthorized plagiarism of any kind;
·
not
contain nudity, inappropriate, indecent, sexually explicit, pornographic, or
obscene content or images (which shall be determined by Sponsor, in its sole
and absolute discretion);
·
not
contain any political or politically themed or motivated messages, statements,
or images;
·
not
promote excessive or underage drinking, drugs, tobacco or firearms;
·
not
defame, slander, libel, misrepresent, or contain disparaging remarks or any
other content that could adversely affect the name, reputation, or goodwill of
Sponsor or any other individuals and/or entities affiliated or associated with
Sponsor, the Contest, or any prizes, the determination of which shall remain in
the sole discretion of Sponsor;
·
not
depict or include images that may be considered unlawful, harmful, threatening,
violent, abusive, harassing, tortuous, defamatory, vulgar, libelous, invasive
of another’s privacy, hateful, or racially, religiously, ethnically or
otherwise objectionable in any manner as solely determined by Sponsor;
·
to
the extent submitted through Instagram or Twitter, adhere to the Instagram or
Twitter terms of use as set forth on the Instagram or Twitter websites.
Representation
and Release of Rights to Photo Submissions: By submitting any
Photo, each contestant represents that s/he has sole and exclusive ownership
and proprietary rights of all Photo images submitted; has full permission of
all parties within Photo to publish and release their images and actions shown
within the Photo; and agrees that each Photo becomes the sole and exclusive property
of Sponsor, and Sponsor may publish, display, promote, or utilize Photo in any
manner of its choosing in relation to the promotion or advertising of the
Contest or Sponsor. Entry into the
Contest and upload of any Photo, constitutes permission for the Sponsor and its
designees to use that contestant’s Photo, name, city and state of residence
and/or likeness for purposes of advertising and trade in any and all media now
or hereafter known worldwide in perpetuity without limitation or further
compensation, notification or permission, unless prohibited by law. Photo submissions will not be acknowledged or
returned by Sponsor.
Sponsor
reserves the right to request from any Entrant at any time proof, in a form
acceptable to Sponsor, of any permission required or possibly required to use
such Entrant’s Photo Entry. Failure to
provide such proof, if requested, may disqualify such Photo Entry from the
Contest.
Sponsor
reserves the right, in its sole discretion, to disqualify any individual (and
all of his or her entries) who tampers or attempts to tamper with or abuse the
entry process or the Contest website in any way or who is otherwise in
violation of these Official Rules, as determined by Sponsor or the Contest
judges appointed by Sponsor in their sole discretion. Any questions regarding the number of entries
submitted or the authorized account holder shall be determined by Sponsor in
its sole discretion. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY
CONTEST WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A
VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE,
SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND SEEK DAMAGES FROM ANY SUCH PERSON
TO THE FULLEST EXTENT PERMITTED BY LAW.
Judging of Photo Submissions –
Determination of Prize Winner (maximum of one grand prize award):
Grand Prize
Winner: At the conclusion of the Entry Period, an
independent panel of judges as solely determined
and appointed by Sponsor/Administrator shall review, select and designate a
maximum of one (1) grand prize winning photo submission from among all eligible
photo submissions received (see judging criteria below).
The
eligible Entrant who submitted the selected photo submission shall be
designated as the potential winner (the “Potential Winner”), subject to
verification of eligibility, and compliance with these Official Rules. Only the contestant whose photo submission was
selected by the judges shall be eligible to claim the grand prize award. If an
insufficient number of eligible entries are received, then the grand prize
shall not be awarded.
Photo
submissions shall be judged by a Sponsor/Administrator-appointed panel of
judges, pursuant to the following
guidelines, requirements and criteria in the
determination of the winning photo submission(s):
The
Potential Winner will be notified initially by
phone, email and/or message posting to the Entrant’s Instagram or Twitter
account no later than 9/30/2021. If the
Administrator is unsuccessful in its attempt to reach and speak directly with the
Potential Winner by phone within 48-hours of
the initial notification attempt to the phone number, email address, Instagram
or Twitter account associated with that contestant’s Entry, then that
contestant may be disqualified and an alternate Potential
Winner may be selected from among the remaining eligible entries and
notified as per the procedures outlined above (time permitting). Note: phone messages will not be left
during the prize winner notification process.
During
prize winner notification, the Potential Winner
must confirm their eligibility, and indicate their willingness and ability to
accept the Sponsor designated prize award.
The Potential Winner will then receive
official notification via mail or email delivery. If any Potential
Winner does not meet the eligibility requirements, or elects to decline
the prize, s/he will be disqualified and, at Sponsor’s discretion and time
permitting, an alternate Potential Winner will
be selected from among all remaining eligible entries and notified as per the
procedures outlined above. Any
disqualified contestant will not receive any alternate prize substitution or
compensation. Decisions of the Administrator in the selection and determination of
prize winner and all matters relating to this Contest are final and
binding.
All
of the following will apply to the prize winner : 1) Winner will be required to
complete and return, within 5-days of date of receipt, a prize acceptance form
including an affidavit of eligibility and liability/publicity release (where
permitted), and a W-9 form (if prize value exceeds $600); 2) Winner may be
required to present a copy of a valid social security card and a valid government
issued identification as a condition of participating or receiving any
prize; 3) Grand Prize Winner will be
issued an IRS Form 1099 reflecting the actual value of the prize award; and 4)
Winners will be responsible for paying all applicable taxes (including, but not
limited to all local, state and federal taxes) on prize award. Failure to collect or properly claim any
prize in accordance with these rules will result in forfeiture of the
prize. If forfeited for any reason, winner
will not receive any other prize substitution or compensation, and the prize
will remain the property of Sponsor and will not be awarded, except as provided
herein.
NOTE: If any prize winner
is under the age of 18, or at least 18 years of age but still considered a
minor in his/her jurisdiction of residence, Sponsor shall award the prize in
the name of his/her parent or legal guardian who must accept the prize on
behalf of the winner, and who will be responsible for completing all required
winner prize acceptance documents and fulfilling all requirements imposed on
winner set forth herein. Any eligible winner who is considered a
minor must travel and be accompanied by his/her parent or legal guardian as
their designated travel guest.
Grand Prize Award: The
Entrant who is confirmed as the grand prize winner (the “Grand Prize Winner’) will
receive the Grand Prize Winner prize package (ARV of $7,750) including the
items as outlined below, and one (1) opportunity to participate in the envelope
pick challenge (the “Challenge”) on behalf of Grand Prize Winner’s designated hometown
little league team or nonprofit baseball organization (the “Designated Team or
Charity”) for an opportunity to award the Designated Team or Charity a $5,000
or $50,000 donation (the ‘Donation’) based on the outcome of the Challenge as
required by these Official Rules. Designated
Team or Charity must be approved by Sponsor.
The Grand Prize
Winner shall receive:

One (1) year's supply of Big League Chew® (432
pouches of assorted flavors).
·
$100 worth of Big League Chew® gear (as determined by
the Sponsor in its sole discretion).
·
Three (3) day/two (2) nights VIP Trip for two
(2) to the National Baseball Hall of Fame and Museum. Trip details and restrictions include:
o
Roundtrip coach air travel for Grand Prize Winner and (1) one
guest from major airport nearest winner’s residence (as determined by Sponsor)
to an airport in the Albany, NY or Syracuse, NY area.
o Three (3)-days/Two (2)-nights standard hotel accommodations, double
occupancy at a hotel as solely designated by Sponsor.
o
Dates and time of trip are at the sole discretion of Sponsor.
o
Blackout dates include but are not limited to the following:

All federal holidays
o All travel arrangements must be made through Sponsor's agent and on
a carrier of Sponsor's choice.
o
The Grand Prize Winner and travel guest must travel together on
the same itinerary and have valid travel documents (e.g., government issued
I.D., passport, major credit card, etc.) along with any other travel
requirements in order to travel to the Grand Prize destination prior to
departure (failure to do so may result in forfeiture of Grand Prize.)
o
If in the judgment of Sponsor air travel is not required due to
the Grand Prize Winner’s proximity to Grand Prize location, ground
transportation will be substituted for round trip air travel at Sponsor's sole
discretion and no compensation will be provided for difference in value, if
any.
o
Sponsor will not replace any lost, mutilated, or stolen tickets,
travel vouchers or certificates.
o
The Grand Prize Winner and his/her travel guest are solely
responsible for satisfying all legally required conditions of travel.
o
Trip and trip components may not be sold, traded, transferred,
separated, rescheduled or refunded.
o
Trip or any trip components are not redeemable for cash.
o
Grand Prize Winner and/or travel guest must have a major credit
card to check-in to the hotel.
o
Sponsor is not liable for any expenses incurred as a consequence
of flight cancellation or delay or any weather or airline issues that prevent
the Grand Prize Winner and travel guest, if applicable, from traveling, in
which event any missed portion of the Grand Prize is forfeited in its entirety
and no substitution will be provided.
o
All expenses and incidental travel costs associated with Grand
Prize acceptance and use not expressly stated in the package description above
as being provided, including but not limited to, meals, incidentals,
gratuities, passenger tariffs or duties, airline fees, surcharges, airport
fees, service charges or facility charges, personal charges at lodging,
security fees, travel of other type of insurance, taxes or other expenses are
the responsibility solely of the Grand Prize Winner and his/her Parent/Legal
Guardian.
o
If Grand Prize Winner or Grand Prize Winner’s guest is a minor,
then Grand Prize Winner must be the parent or legal guardian of such guest.
o
If Grand Prize Winner elects to take prize trip without a guest,
components of the Grand Prize Winner trip will be awarded in
increments/quantities suitable for one traveler and Grand Prize Winner will not
receive any compensation or substitute/alternate prize for same.
o
Grand Prize Winner agrees to maintain his or her behavior and the
behavior of its guest in accordance with
all applicable laws, generally accepted social practices, and adhere to all
rules and regulations applicable to any airline, hotel, venue or other entity connected
to participation in any prize activity, including, without limitation, use of a
prize component. Grand Prize Winner understands and agrees that if Grand Prize
Winner or his/her guest is removed from any activity at any time, or if the Grand
Prize Winner or his/her guest’s behavior at any point is disruptive, causes
damage or could cause damage to person, property or otherwise violates the
policies of an entity associated with the prize, then Grand Prize Winner may be
required to forfeit the remainder of the prize without substitution or
compensation.
o
All travel must be completed by 12/31/2022, or prize shall be
forfeit and no additional substitute prize award or compensation shall be
available.
·
Family Museum Membership: Includes
unlimited one -year, complimentary admission to the Museum for two (2) adults
and their children (up to age (18) plus other benefits that are included in the
Membership.)
·
$250 Visa® Gift Card: Gift card subject to terms and conditions of Visa® Gift Card policies. Sponsor reserves the right, in its sole
discretion, to award multiple gift cards in varying denominations to satisfy
the total amount to be awarded.
·
VIP Archive Tour: Enjoy an
exclusive behind-the-scenes tour of the National Baseball Hall of Fame and
Museum, archives, where you will hear the little-known stories of Hall of
Famers and our National Pastime.
·
Guided Museum Tour: One-hour
tour will highlight your favorite team's history.
·
$250 Museum Store Gift Certificate (onsite
Museum Store only).
·
Envelope Pick Challenge:
Opportunity for the Grand Prize Winner
only (Grand Prize Winner’s guest is excluded from participation) to
participate in the Envelope Pick Challenge (the “Challenge”) on behalf of the
Designated Team or Charity during their grand prize trip as follows:
o
Sponsor shall designate the date, time
and location for the Challenge.
o
Sponsor will present the Challenge participant with one-hundred (100)
unique sealed envelopes.
o
Each of the one-hundred (100) sealed envelopes will contain a
certificate inside the envelope:
§
One (1) envelope will contain the “Winning Certificate” printed
with “$50,000 donation” or other winning symbol or text which clearly
distinguishes it as the winning certificate.
§
Ninety-nine (99) envelopes will contain a “Non-winning
Certificate” printed with “$5,000 donation” or other non-winning symbol or text
which clearly distinguishes it as a non-winning certificate.
o
The Challenge participant will be instructed to select a maximum
of one (1) sealed envelope from a total of one-hundred (100) sealed envelopes
displayed by Sponsor.
o
In order for the $50,000 donation to be awarded to the Designated
Charity or Team, the Challenge participant must select the (1) sealed envelope
that contains the official “Winning Certificate” from the one-hundred (100)
sealed envelopes displayed by the Sponsor.
·
The following requirements apply to the envelope selection
attempt:
o
The attempt must occur in the presence of the Sponsor designated Envelope
Pick Challenge administrator. Any
attempt not made in the presence of the Sponsor designated Envelope Pick
Challenge administrator will be disqualified and is not eligible for the $50,000
donation.
o
All provided sealed envelopes will be identical in size, shape,
and color.
o
Each sealed envelope will be labeled with a number to encompass
the entire range of numbers from one (1) to one-hundred (100). No two sealed envelopes will be printed with
the same number within the set of one-hundred (100) sealed envelopes.
o
Opening more than one (1) sealed envelope for any reason will
disqualify the Challenge participant, and will void any opportunity for the $50,000
donation to be awarded to the Designated Charity or Team.
o
In the event the Challenge participant does not select the one (1)
sealed envelope that contains the “Winning Certificate”, their attempt is ended
and there will be no further opportunity for the $50,000 donation to be awarded
to the Designated Team or Charity. The Designated Team or Charity will be
awarded a $5,000 donation.
o
The corresponding Donation to be awarded (based on the outcome of
the Challenge) will be awarded in the form of a check from Ford Gum and Machine
Co., Inc., made payable to the Designated Team or Charity. The Designated Team or Charity must use the
Donation towards the purchase of team equipment and/or renovating a local
baseball field. Donation may
not be redeemed for personal use by Grand Prize Winner or any member of the
Designated Team or Charity. Grand Prize Winner shall have no rights or claims
of any kind related to the Donation.
o
IMPORTANT: In the event the set of one-hundred (100)
sealed envelopes is found to contain more than (1) “Winning Certificate” for
any reason including due to an error in their preparation or due to any type of
tampering, the Challenge participant’s attempt is void. The Challenge participant will be entitled
only to re-attempt the Envelope Pick Challenge and will be provided a new set
of sealed envelopes prepared by the Administrator for their re-attempt.
Approximate retail value of all
available prizes (including Donation) is $12,750 to a maximum of $57,750 (actual
value will depend on the result of the Challenge the point of departure for the
Grand Prize Winner’s trip and any airfare fluctuations. If actual value of
prize is lower than the stated maximum value of grand prize when prize is
procured and fulfilled, then the difference will not be awarded to the winner.)
All prizes are
non-transferable and no substitution will be made expect as provided herein at
the Sponsor’s sole discretion. The
Sponsor reserves the right to substitute a prize for one of equal or greater
value if the designated prize or any portion thereof should become unavailable
for any reason.
Additional Rules &
Restrictions: By participating, you agree to abide by
and be bound by these Official Rules. In the event any declared winner is later
found to be in violation of these Official Rules, he/she will be required to
forfeit the prize or to reimburse Sponsor for the stated value of the prize if
such violation is discovered after such winner has used the prize. False, fraudulent or deceptive entries or acts shall render Entrants
ineligible for any prize.
By
participating, you agree to hold all Released Parties harmless from any claims,
losses, actions, or damages of any kind, whether actual, incidental or
consequential, for injury (including but not limited to death), damages, losses
or expenses arising out of or relating to your participation in this Contest, or
the acceptance, possession or use/misuse of any prize, or participation in
prize-related activities (including but not limited to travel or activity
related thereto), and to assume all liability therefor.
Released
Parties shall not be liable to winners or any other person for failure to
supply the prize or any part thereof by reason of any acts of God, any actions,
regulations, orders, or requests by any governmental entity, equipment failure,
terrorist acts, war, pandemics, fire, unusually severe weather, embargo, labor
dispute or strike, labor or material shortage, transportation interruption of
any kind, or any other cause beyond Released Parties’ sole control.
Entrants
are restricted to use of ordinary and typical computer equipment, mobile phone
equipment, Internet access and cellular networks. Sponsor and Administrator disclaim
all liability for the inability of an Entrant to complete or continue an entry due
to equipment malfunction, busy lines, inadvertent disconnections, acts beyond
the Sponsor and Administrator’s control,
or otherwise. The Sponsor and Administrator disclaims any liability for entries
not received due to technical difficulties or transmission errors. The Sponsor and
Administrator disclaim all liability for any delays, mis-delivery, loss, or
failure in the delivery of any item sent by mail, courier, express, electronic
transmission, or other delivery method.
Released Parties are not responsible for mechanical, technical,
electronic, communications, telephone, computer, hardware or software errors,
malfunctions or failures of any kind, including: failed, incomplete, garbled or
delayed transmission of online entries, traffic congestion on telephone lines,
the Internet or at any website or lost or unavailable network connections which
may limit any person’s ability to participate in the Contest, and any injury or
damage to that person’s (or any other person’s) computer or mobile phone
related to or resulting from participating in or downloading any information
necessary to participate in the Contest.
Released Parties are not responsible for any other errors of any kind,
whether computer, technical, typographical, printing, human or otherwise,
relating to or in connection with the Contest including, without limitations,
errors which may occur in connection with the printing or advertising of this Contest,
administration or execution of the Contest, the cancellation of the Contest, the
processing of Entries, or in the announcement of the prizes or prize
winners.
Sponsor
reserves the right to cancel, modify or terminate the Contest if fraud,
misconduct or technical failures destroy or threaten the integrity of this
portion of the Contest, in the opinion of the Sponsor/Administrator, or if a
computer virus, bug, or other technical problem corrupts the administration,
security, or proper conduct of the Contest as determined by
Sponsor/Administrator, in their sole discretion. In the event of early
termination of the Contest, Sponsor reserves the right to cause the Administrator
to determine Winner in a fair and equitable manner, if possible, from among all
eligible, non-suspect Entries received as of the time/date of such termination.
IN CASE OF DISPUTES: By
participating, you agree that (1) any and all disputes, claims, and causes of
action arising out of or in connection with this Contest, or any prizes
awarded, shall be resolved individually, without resort to any form of class
action, and any judicial proceeding shall take place in a federal or state
court within the State of New York; (2) any and all claims, judgments, and
awards shall be limited to actual out-of-pocket costs incurred, including costs
associated with entering this Contest, and in no event will Entrant be entitled
to received attorneys' fees or other legal costs; and (3) under no
circumstances will you be permitted to obtain awards for, and you hereby waives
all rights to claim, punitive, incidental, and consequential damages, and any
other damages, other than for actual out-of-pocket expenses, and any and all
rights to have damages multiplied or otherwise increased. All issues and
questions concerning the construction, validity, interpretation and
enforceability of these Official Rules, or the rights and obligations of Entrant
and Sponsor in connection with this Contest, shall be governed by, and
construed in accordance with the laws of the State of New York, without giving
effect to any choice of law or conflict of law rules or provisions (whether of
the State of New York or any other jurisdiction), that would cause the
application of the laws of any jurisdiction other than the State of New York.
Odds
of Winning: Odds of being selected as the Grand Prize Winner
are dependent upon the total number of eligible entries received from all entry
methods combined, the skill of each Entrant, and the decisions of judges. Odds of the $50,000 donation being awarded to
the Designated Team or Charity are 1:100.
