following SWEEPSTAKES is OPEN TO LEGAL U.S. RESIDENTS OF CT, NJ, and NY who reside
within 250 MILES OF Bohemia, NY WHO meet the eligibility requirements (as
defined in the rules below). VOID ELSEWHERE AND WHEREVER
PROHIBITED.

Name: Floor & Decor
PRO Premier Chevy Colorado Sweepstakes (the “Sweepstakes”).
Sweepstakes
Dates: Sweepstakes registration is scheduled to begin at 12:00:00am
Eastern Time (“ET”) on 8/30/2021 and end at 11:59:59pm ET on 10/13/2021 (the “Registration
Period”). The grand prize giveaway event is scheduled to occur on or about 10/28/2021
at Floor & Decor located at 5151 Sunrise Highway, Bohemia, NY 11716. The
Sweepstakes is subject to all applicable federal, state
and local laws and regulations, and is
void where prohibited or restricted by law.
Who
may Enter:
Sweepstakes is open only to legal U.S. residents of CT, NJ, and NY who
reside within 250 miles of Bohemia, NY and who are age 18 or older as of date
of entry with a valid U.S. driver’s license (each an “Entrant”), except the
following classes of persons who are not eligible to enter, participate or win:
(a)
Employees,
officers, and directors of Floor & Decor (“Sponsor”), Million Dollar Media
(the “Administrator”), Floor & Decor vendors (a ‘Vendor’), Selman Chevrolet
and each of their respective franchisees, affiliated companies, subsidiaries, distributors,
retailers, printers, advertising and promotion agencies, and any and all other
companies associated with the design or execution of this Sweepstakes (collectively
“Released Parties”), and the members of the immediate families or households of
any of the above, whether or not related. “Immediate family members” include,
for purposes of this Sweepstakes, parents (including in-laws), grandparents,
siblings (including step-siblings), children (including step-children), grand
children (including step grand-children) and each of their respective spouses. “Vendors” include, for purposes of this
Sweepstakes, anyone who works for a company whose product(s) are sold at Floor
& Decor or anyone who works for a company who has a service contract
directly with Floor & Decor.
(b)
Individuals
who are unable or unwilling to be
present to participate in the grand prize giveaway event
on 10/28/2021 (see below).
How to Enter: To enter, visit www.flooranddecor.com/bohemiapro
during the “Registration Period” and click the entry button to connect to the Sweepstakes
registration page. Each Entrant must fully
complete the on-line registration page with all required information including
his/her name, complete address, valid email address, phone number(s) (including
area code(s)) and any other required questions.
After having read and agreed to these Official Rules, click the submit
button to submit your on-line entry. All
entries must be fully complete for all required information, and must be received
by 11:59:59 pm ET on 10/13/2021 to be eligible. Any entry submitted with an invalid email
address will be disqualified. Sponsor
reserves the right to modify the Registration Period or event date/time at its
sole discretion for any reason including but not limited to store opening
delays, schedule conflicts, acts of God, pandemic related issues, inclement
weather, or any other reason that prevents Sweepstakes to occur as scheduled.
By participating and submitting an
entry, Entrant agrees that Sponsor and its designated parties are authorized to
contact entrant via email, mail, phone or any other form
of media to make contestant aware of information pertinent to the Sweepstakes,
and to distribute information regarding the Sponsor’s featured products,
special events or future contests, promotions or offers. Entrants may opt-out of any further email communication
at any time by simply replying REMOVE to any email message or following the
provided opt-out instructions.
Maximum of one entry per
person.
Any
incomplete or illegible entries will be disqualified. Released Parties are not responsible for lost,
late, misdirected, illegible, incomplete, invalid, unintelligible, damaged, or
for entries submitted in a manner that is not expressly allowed under these
rules, or for any entry not submitted or received due
to any technical error or failure, unauthorized human intervention, inaccurate
capture or mis-entry of any required information, or the failure to capture any
such information for any reason including programming or technical errors, or
effects of hackers or failure of any electronic equipment, computer
or cellular transmissions and/or network connections; all of which will be
disqualified.
Each
Entrant must submit an entry on his/her own behalf. Any entry submitted on behalf of another individual
or using another person’s email address, name or mobile number will be disqualified
and ineligible to claim any prize. Any
attempt by any Entrant to obtain more than the stated number of entries allowed
by using same, multiple/different mobile numbers, identities, or any other
methods void that participant's entries and that participant may be
disqualified. No mechanically-reproduced
or automated entries permitted. Use of
any automated system to participate is prohibited and will result in disqualification
and all such entries will be deemed void.
All entries received become the property of the Sponsor and will not be
returned.
In the event of a dispute as to any on-line registration, the
authorized account holder of the e-mail address used to register will be deemed
to be the registrant and he/she must be eligible according to these Official
Rules. The “authorized email account
holder” is the natural person assigned an e-mail address by an Internet access
provider, online service provider or other organization responsible for assigning
e-mail addresses for the domain associated with the submitted address.
By registering to enter Sweepstakes, you
affirm that you have read and accepted these Official Sweepstakes Rules. All
entrants agree to be bound by & abide by the official rules of the Sweepstakes.
During the Potential Finalist notification phone
call, Potential Finalist must confirm their eligibility, indicate their willingness
and ability to attend the grand prize event on 9/9/2021 at the time as provided
by Administrator during notification process, and confirm they will have a valid U.S. driver’s license in their
possession at the grand prize event in order to participate in the in the grand prize giveaway event (see description
below).
Finalists must
be present with a valid U.S.
driver’s license in their possession at the date, time and location as
specified by Administrator during the notification process to participate in
the (10/28/2021 at Floor & Decor, 5151 Sunrise Highway, Bohemia, NY 11716). Any Finalist who fails to appear and
check-in with their valid U.S. driver’s license with the Sponsor by the
required deadline as determined and provided by Administrator for any reason
may be disqualified, and in such case will not receive any alternate attempts,
prize substitution or compensation. Sponsor
reserves the right in its sole discretion to change the date, time or location of the grand prize event. Finalists will be notified of any changes at
the time of their selection and/or notification. Difficulties
with getting to location to enter or participate in the Sweepstakes are not the
responsibility of Sponsor or Administrator.
All
eligible Finalists who have checked-in with the Sponsor by the required deadline
(including presenting their valid U.S. driver’s license) and are present for the
Grand Prize event will participate in a series of envelope pick contests (the
“Envelope Pick”) as determined by Sponsor, to select a total of one (1) grand prize
winner (see grand prize description below). Decisions of the Sponsor in the execution of
the Envelope Pick, the selection and determination of grand prize winner and all
matters relating to this Sweepstakes are final and binding in all respects.
Grand
Prize Envelope Pick: The Envelope Pick execution will consist of (4) rounds,
unless less than five (5) Finalists are present and have checked-in with the
Sponsor by the required deadline (as determined by Sponsor), in which case the
following will apply:
a) Sponsor will execute the Envelope
Pick starting from the appropriate round as determined by Sponsor based on the
number of eligible Finalists who are present and have checked-in with the
Sponsor by the required deadline (as determined by Sponsor)
or
b) if only one (1) Finalist is present
and has checked-in with the Sponsor by the required deadline (as determined by
Sponsor), the Envelope Pick will not occur and the one (1) Finalist who is present
and has checked-in with the Sponsor by the required deadline (as determined by
Sponsor) will be declared the grand prize winner (see below)
or
c) In the event no Finalist is
present and has checked-in with the Sponsor by the required deadline (as
determined by Sponsor), the prize shall remain the property of Sponsor and
shall not be re-awarded (unless as determined otherwise by Sponsor).
The Envelope Pick execution will be conducted as follows:
Round 1:
Sponsor shall display a total of
(5) prize envelopes. Four (4) prize envelopes will contain a winning certificate
(Floor & Decor logo) and one (1) prize envelope will contain a non-winning certificate
(‘X’). Each of the five (5) Finalists will randomly select (1) of the (5) prize
envelopes in a manner and order as determined by Sponsor. The one (1) Finalist that selects a prize envelope
containing a non-winning certificate is disqualified and is no longer eligible
to win the grand prize. The four (4) Finalists who select a prize envelope
containing a winning certificate as solely determined by Sponsor will advance
to Round 2.
Round
2: Sponsor
shall display a total of (4) prize envelopes.
Three (3) prize envelopes will contain a winning certificate (Floor &
Decor logo) and one (1) prize envelope will contain a non-winning certificate
(‘X’). Each of the four (4) remaining eligible Finalists will randomly select
(1) of the (4) prize envelopes in a manner and order as determined by Sponsor. The one (1) Finalist that selects a prize envelope
containing a non-winning certificate is disqualified and is no longer eligible
to win the grand prize. The three (3) Finalists who select a prize envelope
containing a winning certificate as solely determined by Sponsor will advance to
Round 3.
Round
3: Sponsor
shall display a total of (3) prize envelopes.
Two (2) prize envelopes will contain a winning certificate (Floor & Decor
logo) and one (1) prize envelope will contain a non-winning certificate (‘X’).
Each of the three (3) remaining eligible Finalists will randomly select (1) of
the (3) prize envelopes in a manner and order as determined by Sponsor. The one (1) Finalist that selects a prize
envelope containing a non-winning certificate is disqualified and is no longer
eligible to win the grand prize. The two (2) Finalists who select a prize envelope
containing a winning certificate as solely determined by Sponsor will advance
to Round 4 (Final Round).
Round
4 (Final Round): Sponsor shall display a total of (2) prize envelopes. One (1) prize envelope will contain a winning
certificate (Floor & Decor logo) and one (1) prize envelope will contain a
non-winning certificate (‘X’). Each of the two (2) remaining eligible Finalists
will randomly select (1) of the (2) prize envelopes in a manner and order as
determined by Sponsor. The one (1) Finalist who selects a prize envelope containing
a non-winning certificate is disqualified and is no longer eligible to win the
grand prize. The Finalist who selects a prize envelope containing a winning certificate
as solely determined by Sponsor will be designated as the grand prize winner
IMPORTANT: In the event of an error in the preparation of
the Sweepstakes materials, an error in the administration of the Sweepstakes,
or any tampering that results in a set of sealed prize envelopes for a round containing
more than the appropriate number of “Winning Prize Certificates”, that
particular round is void. Each of the
remaining corresponding Finalists for that round will be entitled only to re-attempt
that round, and will be provided a new set of sealed prize envelopes for their
re-attempt. Any Finalist who has already
been disqualified during the event will not be eligible be a part of the re-attempt
round.
Only
the (1) grand prize winner will be eligible for the grand prize. All other Finalists are ineligible. Failure to collect or properly claim any prize
in accordance with these Official Rules will result in forfeiture of the prize. If forfeited for any reason, the Finalist will
not receive any other prize substitution or compensation, and the prize shall
remain the property of Sponsor and shall not be re-awarded.
Prize Awards &
Delivery:
Grand
Prize: The corresponding
Finalist who completes the grand prize-winning requirements will be eligible to
claim the grand prize (the “Grand Prize Winner”), subject to approval and verification
of compliance with these official rules.
The grand prize is: a 2021 Chevrolet Colorado vehicle with a MSRP not to exceed $37,073.44,
including sales tax.
Grand
Prize Winner must take delivery of vehicle from Sponsor designated dealer. Allow approximately 4-6 weeks for delivery
coordination. Sponsor will designate and
specify available vehicle including make, model, color
and options for prize award. Grand Prize
Winner must have a valid U.S. driver’s license issued in his/her state of residence
and proof of insurance prior to taking delivery. Grand Prize Winner may not
substitute, exchange, or apply the vehicle’s value towards a higher cost or
alternate vehicle, except at Sponsor or Dealer’s sole discretion, and Grand Prize
Winner will be solely responsible for any upgrade costs or additional added
options at time of delivery. Designated
vehicle must be the Sponsor designated vehicle that is currently in designated
dealer’s stock of inventory. Sponsor
reserves the right to award an alternate year model vehicle or alternate vehicle
model, if the designated vehicle model is not available
at the time of prize award. Vehicle on
display at grand prize event is for display purpose only and is not necessarily
the vehicle that will awarded to the Grand Prize Winner.
If
the designated prize vehicle MSRP is under $37,073.44, the winner will not be
awarded the difference between the vehicle's actual MSRP and $37,073.44.
General Prize Conditions: All other costs and expenses related to
prize acceptance, delivery and use not specified herein as being provided are the
sole responsibility of Grand Prize Winner, including but not limited to federal
or state taxes, insurance, property tax, registration/licensing, dealer preparation
fees, delivery charges, transportation costs, travel costs, incidental expenses or any additional required state fees. All income, federal, state
and local taxes (excluding sales tax) are the Grand Prize Winner’s sole responsibility.
Bonus Prizes: A maximum of four (4) bonus prizes (see
below) will be awarded during the event (each a ‘Bonus Prize’). Each eligible finalist
who reveals a non-winning certificate during their attempt during the grand prize
event and is thus ineligible to claim the grand prize will be eligible to claim
one (1) Bonus Prize. A random drawing will take place among the four (4) eligible
non grand prize-winning finalists to randomly assign each finalist one (1) Bonus
Prize. The method of the random drawing and
all elements of the Bonus Prize execution to will be
as determined by Sponsor.

All prize awards are non-transferable and
no cash redemption or prize substitution allowed, except at Sponsor’s sole discretion
or as provided herein. Sponsor reserves
the right to substitute a prize with one of comparable or greater value, at its
sole discretion. All prizes are awarded as is, without any
warranty, express or implied, by Sponsor.
Other restrictions may apply. Failure
to collect or properly claim any prize in accordance with these rules will
result in forfeiture of the prize. All properly claimed prizes will be awarded. Any unclaimed or forfeited prizes will not be
awarded.
All
of the following will apply to the Grand Prize Winner: 1) winners will be
required to complete and return immediately following their determination as the
potential prize winner, a prize acceptance form including an affidavit of eligibility
and a liability/publicity release (where permitted); and a W-9 form (for U.S.
winners for prizes valued over $600); 2) winners will be required to present a copy
of a valid U.S. driver’s license as a condition of receiving any prize. Winners
will be issued a 1099 form reflecting the value of the prize award and is responsible
for paying all applicable taxes on prize.
Additional Rules & Restrictions: By
participating, entrants agree to abide by and be bound by the Official Rules
and the decisions of the Sponsor and Administrator, which shall be final in all
matters relating to this Sweepstakes. In
the event an entrant wins a prize, and is later found to be in violation of these
rules he/she will be required to forfeit the prize or to reimburse Sponsor for
the stated value of the prize if such violation is discovered after winner has
used the prize, and the prize or reimbursement of prize shall remain the
property of Sponsor and shall not be re-awarded. Participation in Sweepstakes
constitutes permission for the Sponsor, the Released Parties
and their designees to use entrants’ names, likenesses, images, biographical
information, and cities and states of residence for purposes of advertising and
trade in any and all media now or hereafter known worldwide on perpetuity without
limitation or further compensation, notification or permission, unless
prohibited by law. False, fraudulent or
deceptive entries or acts shall render entrants ineligible
for any prize.
By participating,
entrants agree to hold all Released Parties harmless from any claims, losses,
actions, or damages of any kind, whether actual, incidental or consequential,
for injury (including but not limited to death), damages, losses or expenses
arising out of or relating to entrant’s participation in this Sweepstakes, or
the acceptance, possession or use/misuse of any prize, or participation in
prize-related activities (including but not limited to travel or activity related
thereto), and to assume all liability therefor.
Released Parties
shall not be liable to winner or any other person for failure to supply the prize
or any part thereof by reason of any acts of God, any actions, regulations, pandemic/epidemic,
orders, or requests by any governmental entity, equipment failure, terrorist acts,
war, fire, unusually severe weather, embargo, labor dispute or strike, labor or
material shortage, transportation interruption of any kind, or any other cause
beyond Released Parties’ sole control.
Entrants are
restricted to use of ordinary and typical computer equipment, mobile phone
equipment, Internet access and cellular networks. Sponsor disclaims all liability
for the inability of an Entrant to complete or continue an entry due to equipment
malfunction, busy lines, inadvertent disconnections, acts beyond the Sponsor’s control,
or otherwise. The Sponsor disclaims any liability for entries not received due
to technical difficulties or transmission errors. The Sponsor disclaims all liability
for any delays, mis-delivery, loss, or failure in the delivery of any item sent
by mail, courier, express, electronic transmission, or other delivery
method. Released Parties are not responsible
for mechanical, technical, electronic, communications, telephone, computer, hardware
or software errors, malfunctions or failures of any kind, including: failed, incomplete,
garbled or delayed transmission of online entries, traffic congestion on
telephone lines, the Internet or at any website or lost or unavailable network
connections which may limit an online entrant's ability to participate in the
Sweepstakes, and any injury or damage to entrant’s or any other person’s
computer or mobile phone related to or resulting from participating in or downloading
any information necessary to participate in the Sweepstakes. Released Parties are not responsible for any
other errors of any kind, whether computer, technical, typographical, printing,
human or otherwise, relating to or in connection with the Sweepstakes, including,
without limitations, errors which may occur in connection with the printing or advertising
of this Sweepstakes, administration or execution of the Sweepstakes, the cancellation
of the game, the processing of entries or in the announcement of the prizes or
prize winners. Sponsor, in its sole discretion,
reserves the right to disqualify any person tampering with the entry process or
the operation of the Sweepstakes website.
Sponsor reserves
the right to cancel, modify or terminate the Sweepstakes if fraud, misconduct, administration
errors or technical failures destroy or threaten the integrity of the Sweepstakes,
in the opinion of the Sponsor/Administrator, or if a computer virus, bug, or
other technical problem corrupts the administration, security, or proper conduct
of the Sweepstakes as determined by Sponsor/Administrator, in their sole discretion.
In the event of early termination of the Sweepstakes, Sponsor reserves the
right to determine any prize winners in a random drawing from among all eligible,
non-suspect entries received as of the time/date of such termination.
IN CASE OF DISPUTES: By
participating, each Entrant agrees that (1) any and all disputes, claims, and
causes of action arising out of or in connection with this Sweepstakes, or any rebates
awarded, shall be resolved individually, without resort to any form of class
action, and any judicial proceeding shall take place in a federal or state
court within the State of New Jersey; (2) any and all claims, judgments, and awards
shall be limited to actual out-of-pocket costs incurred, including costs associated
with entering this Sweepstakes, but in no event attorneys' fees; and (3) under
no circumstances will entrant be permitted to obtain awards for, and Entrant
hereby waives all rights to claim, punitive, incidental, and consequential damages,
and any other damages, other than for actual out-of-pocket expenses, and any and
all rights to have damages multiplied or otherwise increased. All issues and
questions concerning the construction, validity, interpretation and enforceability
of these Official Rules, or the rights and obligations of Entrant and Sponsor in
connection with this Sweepstakes, shall be governed by, and construed in accordance
with the laws of the State of New Jersey, without giving effect to any choice
of law or conflict of law rules or provisions (whether of the State of New Jersey
or any other jurisdiction), that would cause the application of the laws of any
jurisdiction other than the State of New Jersey.
Odds: The odds of being selected as a Finalist to
participate in the grand prize event are dependent upon the number of eligible
entries received. The odds of winning
the grand prize once selected as a finalist are: 1:5 based upon all eligible Finalists
being present at the Grand Prize event.
