Sweepstakes
Name: 12-Days of Team USA Holiday Sweepstakes (the “Sweepstakes”).
Sweepstakes Dates: Sweepstakes registration begins at 12:00:00am
Eastern Time (“ET”) on 12/6/2022 and
ends at 11:59:59pm ET on 12/17/2022 (the
“Registration Period”). The Sweepstakes is subject to all applicable
federal, state and local laws and regulations and is
void outside of the 50 U.S. or D.C., and wherever prohibited or restricted by
law.
Who may Enter: Sweepstakes is open only to legal residents
of the 50 U.S. and D.C., who are age 18 or older as of date of entry, and have
a valid driver’s license or government issued photo ID, except the following
persons who are not eligible to enter or win:
(a)
Employees,
officers, and directors of the United States Olympic and Paralympic Properties,
LLC (“Sponsor”), Million Dollar
Media (the “Sweepstakes Administrator”), any official Olympic or Paralympic organization or entity
(including the International Olympic Committee, the International Paralympic Committee,
the United States Olympic and Paralympic Committee and
the Los Angeles Organizing Committee for the Olympic and Paralympic Games 2028),
and each of their respective co-venturers, partners, franchisees,
parents, affiliated companies, subsidiaries, distributors, licensors or licensees,
retailers, printers, legal counsel, professional advisors, advertising and
promotion agencies, and any and all other companies associated with the design
or execution of this promotion (collectively, “Released Parties”), and the
members of the immediate families or households, whether or not related, of any
of the above. “Immediate family members” includes, for purposes of this
promotion, parents (including in-laws), grandparents, siblings (including step-siblings), children (including step-children), grand children
(including step grand children) and each of their respective spouses, regardless
of where they reside.
How to Enter –
Internet Entry:
To enter, visit www.TeamUSA12Days.com during the Registration
Period. Each entrant must fully complete
the online registration page with all required information including name,
complete address (including city, state and zip code), valid email address, birth date,
and phone number (including area code).
After having read and agreed to these
Official Rules, click the submit button to submit your online entry. All online entries must be fully complete with
all required information, and must be received by 11:59:59p ET on 12/17/2022 to be eligible. Any online entry submitted with an invalid
email address or invalid or incorrect information will
be disqualified.
Limit of one registration
per person and per valid email address during the entire Registration Period,
but once registered eligible entrants may participate in the instant win game (see
below) up to one time per day during the remainder of the Sweepstakes Period. Your
registered email address may be used to login for each return visit to
participate in the daily instant win game.
If
entering via a mobile device, standard data rates may apply, as dictated by
your wireless provider. Data rates vary so you should contact your wireless
provider for further information on your specific data rates.
Any
incomplete or illegible entries will be disqualified. Released Parties are not responsible for
lost, late, misdirected, incorrect, illegible, incomplete, invalid, unintelligible,
or damaged entries, or for entries submitted in a manner that is not expressly
allowed under these Official Rules, or for any entry
not submitted or received due to any technical error or failure, human error, unauthorized
human intervention, inaccurate capture or mis-entry of any required
information, failures, omissions, interruptions, deletions, or defects
of any cell phone provider, network computer online systems, computer
equipment, servers, or software, including any injury or damage to participant’s
or any other person’s computer relating to or resulting from participation in
this Sweepstakes; or the failure to capture any such information or effects of
hackers or failure of any electronic equipment, computer or cellular
transmissions and/or network connections; all of which will be disqualified.
Any available
opt-in opportunities are not required to enter the Sweepstakes
or to be eligible to win a prize, and opting-in will not improve your chances
of winning. By
participating and submitting an entry, participant agrees that Sponsor and Sweepstakes
Administrator are authorized to contact entrant via email, text, mail, phone or any other form of media to make participant aware
of information pertinent to the Sweepstakes, and to distribute information
regarding the Sponsor(s) featured products, special events or future contests,
promotions or offers. Participant may
opt-out of any further email communication at any time, without affecting their
entry or eligibility to win a prize, by simply replying REMOVE to any email
message, or following the provided opt-out instructions.
Each
participant must submit an entry on his/her own behalf. Any entry submitted on behalf of another
individual or using another person’s email address or name will be disqualified
and ineligible to claim any prize. No
mechanically reproduced or automated entries permitted. Use of any automated system to participate is
prohibited and will result in disqualification and all such entries will be
deemed void. False, fraudulent and/or deceptive
entries or acts, including misrepresentation of age, or providing any false or
incorrect information during registration, shall render such entries ineligible
and such participants ineligible for any prize. Any attempt by any participant to obtain more than the
stated number of entries allowed by using same, multiple/different email
accounts, identities, or any other methods void that participant's entries and that participant may be disqualified.
In
the event of a dispute as to any online registration, the authorized account holder
of the email address used to register will be deemed to be the registrant and he/she
must be eligible according to these Official Rules. The “authorized email account holder” is the
natural person assigned an email address by an Internet access provider, online
service provider or other organization responsible for assigning email addresses
for the domain associated with the submitted address.
By
entering the Sweepstakes, participant affirms that s/he has read and accepted
these Official Rules. Any information
collected by registering to enter the Sweepstakes or in connection with receipt
of any prize shall be used only in a manner consistent with these Official
Rules and with Sweepstakes Administrator’s Privacy Policy as posted on www.TeamUSA12Days.com
or the Sponsor’s Privacy Policy as posted on https://www.teamusa.org/footer/privacy-policy,
as applicable. All entries received become the property of the Sponsor
and will not be acknowledged or returned.
How to Play – Instant Win Game
(daily
instant win prize awards):
After completing
the online registration page (first time visitors) or logging in with your
registered email address (for return visitors), click the link to the ‘Instant
Win’ game play page. The game play page
will then display a virtual image of Team USA gift boxes. To determine if you are an instant prize
winner, click any gift box image of your choice.
Eligible
participants have the opportunity to participate in
the instant win game once per day, each day during the entire Sweepstakes Period. Participants may return to the website to
play the instant win game each day. Each
‘day’ shall be defined as occurring between 12:00:00am ET to 11:59:59pm ET.
After
clicking a gift box image, the website will determine if the participant is a
daily instant win prize winner, and the participant shall receive an online message
verifying if they are an instant winner.
If the participant is an instant winner, the participant will receive an
instant winner confirmation message, prize description and an associated
unique prize claim code on their results page.
If the participant is not designated as an instant winner, receives the
non-winning results message, or has not received a valid unique prize claim
code for any reason, then that participant will not be an instant prize winner
for that game play attempt.
Daily instant prize winners will be
randomly determined throughout the Sweepstakes Period (one per day). A maximum total
of twelve (12) potential instant winners will be randomly determined during the
Sweepstakes Period, based upon randomly selected and predetermined winning
dates and times. The first eligible participant
who participates in the instant win game at or following a pre-scheduled
winning date and time, shall receive an instant win prize message, and shall be
eligible to claim the associated daily instant win prize award (see below).
Claiming a daily instant win
prize award: Participants must print or record their unique
prize claim code and must follow the online instructions provided.

Daily
Instant Win Prize Awards: The maximum number of instant win prize awards
available during the entire Sweepstakes Period are as listed above. Sponsor reserves the right to award an
alternate merchandise prize award of approximate equal or greater value, for
any daily instant win prize at its sole discretion, based upon availability. Sizes are based upon availability and as
solely determined and designated by Sponsor.
No more than the advertised number of daily instant win prizes will be
awarded for any reason. Each daily instant
win prize winner will receive online instructions for prize redemption, and/or
may be contacted by the Sweepstakes Administrator to confirm or coordinate
prize delivery. In the event any scheduled instant win prize is unavailable at time of
prize award, sponsor reserves the right to substitute an alternate prize of
equal or greater value at its sole discretion.
Total ARV of all available instant win prize awards: $2,404.
IMPORTANT: In the event of any technical or programming
errors, tampering, or any error or malfunction of any kind that results in more
than the scheduled number of participants being notified they are an instant prize
winner – then all such claimants shall be placed into a random drawing, and the
actual scheduled number of instant prize winners as listed above will be
randomly selected from all eligible participants receiving an instant win prize
notification or submitting an instant winning prize claim. The maximum number of instant win prize
awards are as listed above, regardless of the number of participants who claim
to have received, or who have actually received, an
instant win online prize notification.
General Prize
Conditions: EACH
POTENTIAL WINNER OF ANY DAILY INSTANT WIN PRIZE IS SUBJECT TO VERIFICATION BY SWEEPSTAKES
ADMINISTRATOR OR SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS
RELATED TO THE SWEEPSTAKES. ANY
POTENTIAL WINNER IS NOT A PRIZE WINNER UNLESS OR UNTIL THE POTENTIAL WINNER’S
ELIGIBILITY HAS BEEN VERIFIED AND THE POTENTIAL WINNER HAS BEEN NOTIFIED THAT
VERIFICATION IS COMPLETE AND NO FURTHER ACTION IS NEEDED.
During the
winner notification and/or verification process, any potential winner must
confirm his/her eligibility and indicate his/her willingness to accept the applicable
prize. If the selected potential
winner does not meet the eligibility requirements, is unable or
unwilling to accept the prize in accordance with the requirements of these Official
Rules, or elects to decline
the prize, he/she will be disqualified and, at Sponsor’s discretion and time
permitting, an alternate potential winner will be randomly selected from among
all remaining eligible entries and notified as per the procedures outlined
above. Any disqualified participant will
not receive any alternate prize, substitution or
compensation. Prizes cannot be exchanged for cash value.
All
of the following will apply to each prize winner: 1) each winner will be required
to complete and return, within 3-days
of date of receipt, a prize acceptance form, including an affidavit of eligibility
and a liability/publicity release (where permitted) in order to be eligible to
claim any prize; 2) prize winner may be required to present a copy of a valid
driver’s license or government issued photo ID with valid residential address as
a condition of participating or receiving any prize; and (3) prize winner shall
be solely responding for paying all applicable taxes (including, but not
limited to, all local, state and federal taxes) that may be or become due in
connection with their respective prize award.
All
prize winners must accept delivery of prize in the method as solely determined
and designated by Sponsor. Prize shall
be shipped to the designated winner’s residential address, as provided at the
time of entry and/or winner notification, via USPS or other Sponsor designated
shipping/mail carrier, or as otherwise designated by Sponsor. Allow approximately 8 – 12 weeks for delivery.
Once
shipped, prize shall be considered awarded, delivered
and fulfilled, and Sponsor shall not be responsible for any prize shipment that
is lost, late, delayed, undelivered, misdirected, misdelivered, damaged or
stolen, or any incorrect, incomplete or illegible shipping address provided by
winner. In the event of any delivery
issues, prize award shall not be replaced or substituted with any alternate prize
award or compensation. Winner shall look
solely to designated shipper/carrier and not to Sponsor or any of the other
Released Parties for any delivery issues.
All other costs and expenses related to
prize delivery, acceptance and use not specified herein as being provided are
the sole responsibility of each winner, including but not limited to delivery
charges, travel, or any incidental expenses. All income, federal, state
and local taxes are the winner’s sole responsibility. All prize awards are non-transferable
and no cash redemption or prize substitution allowed, except at Sponsor’s sole
discretion or as provided herein. Sponsor
reserves the right to substitute a prize with one of comparable or greater value,
at its sole discretion.
All merchandise
prizes are awarded as-is, without any warranty, express or implied (including,
without limitation, any implied warranty of merchantability or fitness for a
particular purpose), by Sponsor. Failure
to collect or properly claim any prize in accordance with these Official Rules will
result in forfeiture of the prize. If
forfeited for any reason, participant will not receive any other prize substitution
or compensation, and the prize will
remain the property of Sponsor and will not be awarded, except as provided
herein. All
properly claimed prizes will be awarded.
Any unclaimed prizes will not be awarded.
NOTE: In the event any prize winner is considered a
minor in his/her state/province of residence, the prize(s) shall be awarded to
the winner’s legal parent or guardian, and the legal parent or guardian shall
be required to complete any necessary paperwork on behalf of the prize winner, and accept delivery of the prize on behalf of the prize
winner.
Decisions
of the Sweepstakes Administrator and Sponsor in the selection and determination
of any prize winners, the award of any prizes and all matters relating to this
Sweepstakes are final and binding in all respects.
Social Media Disclaimer: By entering
this Sweepstakes, participant fully releases and discharges Facebook Inc., Instagram,
Inc. and Twitter, Inc., or any other social media platform or forum where this
Sweepstakes is promoted or administered by Sponsor or Sweepstakes Administrator
(each, a “Social Platform”), from and against any and all
liability associated with or arising from the promotion or administration of
this Sweepstakes. THIS SWEEPSTAKES IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED
BY OR ASSOCIATED WITH ANY SOCIAL PLATFORM. Sweepstakes Administrator shall be
solely responsible for the lawful administration of this Sweepstakes, including,
without limitation, for maintaining and enforcing these Official Rules, for
verifying all eligibility requirements and ensuring that this Sweepstakes complies
with all applicable local, state and federal laws. Sponsor
and/or Sweepstakes Administrator shall be responsible for ensuring that the
promotion and administration of this Sweepstakes complies with any applicable
community guidelines or terms of use for each applicable Social Platform,
including Facebook’s Community Standards, Instagram’s Community Guidelines, and
Twitter’s Rules. Any entrant found to have used multiple accounts on any Social
Platform to enter or win shall be declared ineligible
to participate. Multiple entries from the same account user on any Social Platform
in any single day shall not be accepted.
Additional
Rules & Restrictions: By participating, entrants agree to abide
by and be bound by these Official Rules and the decisions of the Sponsor and Sweepstakes
Administrator, which shall be final in all matters relating to this
Sweepstakes. In the event an entrant
wins a prize and is later found to be in violation of these rules he/she will
be required to forfeit the prize or to reimburse Sponsor for the stated value
of the prize if such violation is discovered after winner has received the
prize.
To
the fullest extent permitted by applicable law, participant’s entry and participation
in this Sweepstakes constitutes permission for the Sponsor and its designees to
use entrants’ name, cities and states of residence and/or aural and visual likenesses
for purposes of advertising, marketing, promotional purposes and trade (including
in a public-facing winners list) in any and all media now or hereafter known
worldwide and in perpetuity, without limitation or further compensation, notification
or permission. False, fraudulent
or deceptive entries or acts shall render entrant ineligible for any prize.
By
participating, entrants agree to defend, indemnify and hold harmless the Sponsor,
the Sweepstakes Administrator, the United
States Olympic and Paralympic Committee, the Los Angeles Organizing Committee
for the Olympic and Paralympic Games 2028, and all other Released Parties, from
and against any and all claims, losses, actions, expenses, costs (including
reasonable attorney’s fees) or damages of any kind, whether punitive, special actual,
indirect, incidental or consequential, for injury (including but not limited to
death), damages, losses (including loss of use or loss of profits or data) or
expenses, whether arising at law or equity, and whether arising in an action in
contract, tort (including negligence) or otherwise, or whether known or unknown,
arising out of or relating to this Sweepstakes, including, without limitation,
entrant’s participation in this Sweepstakes, or the acceptance, possession or
use/misuse of any prize, or participation in prize-related activities (including
but not limited to travel or activity related thereto), and to assume all
liability therefor. In no event shall
the aggregate liability of the Released Parties arising out of or relating to
the Sweepstakes exceed the value of any prize awarded. To the extent limited by
law, the foregoing limitations shall not limit liability for personal injury or
property damages caused by a Released Party’s gross negligence, intentional misconduct or fraud.
Released
Parties shall not be liable to winner or any other person for any delay or failure
to administer the Sweepstakes and/or to supply the prize or any part thereof by
reason of any acts of God, pandemics, any actions, regulations, orders, or
requests by any governmental entity, equipment failure, terrorist acts, war, fire,
unusually severe weather, embargo, labor dispute or strike, labor or material
shortage, transportation interruption of any kind, or any other cause beyond
Released Parties’ sole control.
Participants
are restricted to use of ordinary and typical computer equipment, mobile phone
equipment, Internet access and cellular networks. The Released Parties disclaim
all liability for the inability of a participant to complete or continue an
entry due to equipment malfunction, busy lines, inadvertent disconnections, acts
beyond the Released Parties’ control, or otherwise. The Released Parties disclaim
any liability for entries not received due to technical difficulties or
transmission errors. The Released Parties disclaim all liability for any
delays, mis-delivery, loss, or failure in the delivery of any item sent by mail,
courier, express, electronic transmission, or other delivery method. Released Parties are not responsible for mechanical,
technical, electronic, communications, telephone, computer, hardware or software
errors, malfunctions or failures of any kind, including: failed, incomplete,
garbled or delayed transmission of online entries, traffic congestion on
telephone lines, the Internet or at any website or lost or unavailable network
connections which may limit an online entrant's ability to participate in the
Sweepstakes, and any injury or damage to entrant’s or any other person’s
computer or mobile phone related to or resulting from participating in or
downloading any information necessary to participate in the Sweepstakes. Released Parties are not responsible for any
other errors of any kind, whether computer, technical, typographical, printing,
human or otherwise, relating to or in connection with the Sweepstakes,
including, without limitations, errors which may occur in connection with the printing
or advertising of this Sweepstakes, administration or execution of the
Sweepstakes, the cancellation of all or any part of the Sweepstakes, the
processing of entries or in the announcement of the prizes or prize
winners. Sponsor and/or Sweepstakes
Administrator, in their sole discretion, reserve the right to disqualify any
person tampering with the entry process or the operation of the Sweepstakes website.
Sponsor
and/or Sweepstakes Administrator’s failure to enforce any term of these
Official Rules will not constitute a waiver of that provision or any other
provision of these Official Rules. Any
provision of these Official Rules deemed unenforceable will be enforced to the
greatest extent permissible, and the remainder of these Official Rules will
remain in effect. The use of the terms “include” or “including” in these Official Rules is
illustrative and not limiting.
Sweepstakes
Administrator and/or Sponsor reserve the right to cancel, modify, reschedule or
terminate the Sweepstakes for any reason including, but not limited to acts of God,
pandemics, force majeure, government regulatory action or ruling, fraud, misconduct, or if any technical failures
destroy or threaten the integrity of the Sweepstakes, in the opinion of the Sponsor
and/or Sweepstakes Administrator, or if a computer virus, bug, or other
technical problem corrupts the administration, security, or proper conduct of
the Sweepstakes as determined by Sponsor and/or Sweepstakes Administrator, in
their sole discretion. In the event of early termination of the Sweepstakes,
Sponsor and/or Sweepstakes Administrator reserve the right to determine prize
winners in a random drawing from among all eligible, non-suspect entries received
as of the time/date of such termination.
IN CASE OF DISPUTES: By
participating, each entrant agrees that (1) any and all disputes, claims, and
causes of action arising out of or in connection with this Sweepstakes, or any
prizes awarded, shall be resolved individually, without resort to any form of
class action, and any judicial proceeding shall take place in a federal or
state court within the State of California; (2) any and all claims, judgments,
and awards shall be limited to actual out-of-pocket costs incurred, including
costs associated with entering this Sweepstakes, and in no event will entrant be
entitled to received attorneys' fees or other legal costs; and (3) under no
circumstances will entrant be permitted to obtain awards for, and entrant
hereby waives all rights to claim, punitive, incidental, and consequential
damages, and any other damages, other than for actual out-of-pocket expenses,
and any and all rights to have damages multiplied or otherwise increased. All
issues and questions concerning the construction, validity, interpretation and
enforceability of these Official Rules, or the rights and obligations of
entrant and Sponsor in connection with this Sweepstakes, shall be governed by,
and construed in accordance with the laws of the State of California, without
giving effect to any choice of law or conflict of law rules or provisions (whether
of the State of California or any other jurisdiction), that would cause the application
of the laws of any jurisdiction other than the State of California.
Odds: Odds
of winning a daily instant win prize award are dependent upon the total number
of eligible entries received, and daily participation.
