WHEREVER PROHIBITED. BY PARTICIPATING IN
THIS SWEEPSTAKES, YOU AGREE TO BE BOUND BY THESE OFFICIAL RULES AND THE
DECISIONS OF SPONSOR AND ADMINISTRATOR.

Name: Zig-Zag Friend Trip Sweepstakes (the “Sweepstakes”).
Sweepstakes
Dates: Sweepstakes registration is scheduled to begin at
12:00:00am Eastern Time (“ET”) on 9/5/2026 and end at
11:59:59pm ET on 11/26/2026 (the “Registration
Period”). The Sweepstakes is subject to all applicable federal,
state and local laws and regulations and is void outside of the fifty (50) U.S.
and D.C., and wherever prohibited or restricted by
law.
Who may Enter: Sweepstakes
is open only to legal residents of the fifty (50) U.S. and D.C., who are
age 21 or older as of date of entry, and have a valid U.S. driver’s license or
government issued photo ID, except the following persons who are not eligible
to enter or win:
(a) Employees,
officers, and directors of ”), Turning
Point Brands (the “Sponsor”), Zig-Zag Rolling Papers, Million
Dollar Media (the “Sweepstakes Administrator”), and each of the
foregoing’s respective franchisees, owners, employees, contractors, parents,
affiliated companies, subsidiaries, distributors, retailers, printers,
advertising and promotion agencies, and any and all other companies associated
with the design or execution of this promotion (collectively, “Released
Parties”), and the members of the immediate families or households, whether or
not related, of any of the above. “Immediate family members” includes, for purposes
of this promotion, parents (including in-laws), grandparents, siblings
(including step-siblings), children (including step-children), grand children (including step
grandchildren) and each of their respective spouses, regardless of where they
reside.
How to Enter – Online Registration: To
enter, scan the QR Code on applicable point-of-sale material using your mobile
device’s camera or directly visit www.ZigZagOffers.com during the “Registration
Period”. Each entrant must fully
complete the online registration page with all required information including
his/her name, valid email address, phone number (including area code), state of
residence, and date of birth. After
having read and agreed to these Official Rules, and agreeing to receive offers
and updates via email from Sponsor, click the submit button to submit your
online entry. The Sweepstakes Administrator’s computer, or that of its
designee, runs the official clock for the Sweepstakes and will
solely determine the time by which an entry is received.
Bonus Entries:
1)
Upload Photo or Video: During registration,
each entrant has the option to upload one (1) photo or video of their Zig-Zag
friend group they would like to take on the Zig-Zag Friend Trip. Each entrant who
uploads an eligible photo or video (see guidelines below) shall receive a
maximum of one (1) bonus entry into the Sweepstakes grand prize drawing.
2)
Referral Entry: After
completing your entry, each entrant will have the option to share the
Sweepstakes utilizing a personalized URL link provided on the entry
confirmation page. If you choose to share the URL, you will earn an additional
bonus entry into the Sweepstakes grand prize drawing for each entrant who
completes an entry utilizing your shared personalized URL link.
If you enter using a mobile device on a wireless service provider’s
network (as opposed to a Wi-Fi network), your carrier’s text and data rates
will apply. You should consult your wireless service provider’s pricing plan
for details. Each participant must submit an entry on his/her own behalf. Any entry submitted on behalf of another
individual or using another person’s name, email address, or optional video/photo
submission, or providing any false email addresses or information, will be
disqualified and ineligible to claim any prize.
Any attempt by any participant to obtain more than the stated number of
entries allowed by using same, multiple/different emails or Instagram accounts,
identities, or any other methods void that
participant's entries and that participant may be disqualified. No
mechanically produced or automated entries permitted. Use of
any automated system to participate is prohibited and will result in
disqualification and all such entries will be deemed void. False and/or deceptive entries or acts,
including misrepresentation of age, shall render such entries ineligible.
All Entries in the Sweepstakes
become the sole property of Sponsor and will not be returned. Each Entrant agrees that their submitted
Entry (including optional video and/or photo content) may be viewed by the
public. Sponsor reserves the right to
disqualify and remove any Entry at any time that is not in compliance with
these Official Rules. All Entries must
conform to the submission requirements as outlined above and below, or it may
be disqualified and not considered for the Sweepstakes.
Any other individuals (if any)
included in an Entry, must be 21 or older and must provide
Entrant with express consent and permission for their images to be included and
submitted in the Sweepstakes, and such Entrant is solely responsible for
obtaining all authorizations or approvals.
The individual who submitted the Entry shall be designated as the
official Entrant participating in the Sweepstakes, regardless of any other
individuals included in the Entry, and shall be the only individual eligible
for any resulting prize award (see below).
Any Entry completed and submitted on behalf of another individual or using
another person’s name or email address, or use of any unauthorized photo,
video, or essay submission will be disqualified.
All entries must
include all required information. Any
entry with incorrect, incomplete or illegible information, an invalid email
address, phone number or other inaccurate information will be
disqualified. Released
Parties are not responsible for lost, late, misdirected, incorrect, illegible,
incomplete, invalid, unintelligible, or damaged entries, or for entries
submitted in a manner that is not expressly allowed under these Official Rules,
or for any entry not submitted or received due to any technical error or
failure, human error, unauthorized human intervention, inaccurate capture or
mis-entry of any required information, failures, omissions, interruptions,
deletions, or defects of any phone or cellular phone provider, network computer
online systems, computer equipment, servers, or software, including any injury
or damage to entrant’s or any other person’s computer relating to or resulting
from participation in this Sweepstakes; or the failure to capture any such
information or effects of hackers or failure of any electronic equipment,
computer, phone line or cellular transmissions and/or network connections; all
of which will be disqualified.
In the event of a dispute as to any entry, the authorized
account holder of the email address used to register or submit the entry, will be deemed to be the registrant and s/he must be
eligible according to these Official Rules.
The “authorized email account holder” is the natural person assigned an
email address by an Internet access provider, online service provider or other
organization responsible for assigning email addresses for the domain
associated with the submitted address. Proof
of being the authorized account holder may be required.
By
participating and submitting an Entry, entrant agrees that Sponsor and
participating parties are authorized to contact entrant via email, mail, phone,
text, direct message, or any other form of media to make entrant aware of
information pertinent to the Sweepstakes, and to distribute information
regarding the Sponsor(s) featured products, special events or promotional
offers. Entrants may opt-out
of any further email communication at any time by simply replying
REMOVE to any email message, or following the provided opt-out instructions. Any available opt-in
opportunities are not required to enter the Sweepstakes,
and checking the opt-in boxes will not improve your chances of winning.
By
registering and submitting an Entry, you affirm that you have read and accepted
these Official Rules. The
laws of the United States apply to and govern this Sweepstakes
and any claims must be raised and resolved in the United States. Any information collected by registering and
entering the Sweepstakes shall be used only in a
manner consistent with these Official Rules and with Sponsor’s Privacy Policy.
By entering the Sweepstakes, each entrant agrees that s/he may be contacted,
recorded and/or broadcasted by Sponsor, and that his/her video and/or photo
content submission may be used, promoted, released, broadcasted or published by
Sponsor in any manner related to the promotion or advertising of the Sweepstakes.
General
Entry Submission Requirements:
(a)
Each
Entry must be submitted in a format as accepted by the online entry site;
(b)
Must
be the Entrant’s own original creation;
(c)
Any
photo and/or video submission that is not properly submitted or received for
any reason, including any technical difficulties, upload failures; failures to
save or properly store the photo or video; busy signals, efforts of hackers; or
any lost or disconnected internet connections, will be disqualified.
Additional
Video and/or Photo Content Submission Entry Requirements (Show us your Zig-Zag
Friend Group you’d take on the Zig-Zag Friend Trip.): Sponsor
reserves the right in its sole discretion, to disqualify any entry for any
reason that it considers to not be appropriate for the Sweepstakes. Video and/or Photo content submission restrictions
include, but are not limited to, the following requirements:

may
not depict an image of any individual under the age of 21, or that appears to
be under the age of 21;
·
not
be, or ever have been, submitted in any competition or sweepstakes of any kind;
·
not
use any name, likeness, photograph, or any other identifying element, in whole
or in part, of any person, living or dead, without permission;
·
not
be subject to any third-party agreement or require payment or incurrence of any
sums to obtain further permissions of any person or entity as
a result of its use or exploitation of the idea or rights therein or
portions, or modified versions or derivative works thereof;
·
except
as relates to the sponsoring brand(s), company, agency, or approved partners,
not include trademarks, logos, or copyrighted material not owned by Entrant or
material that is used without permission (including but not limited to company
names, photographs, works of art, or images published on any media) or that
otherwise infringes or violates the rights of any third party (including but
not limited to, copyrights, trademarks, patents, trade secrets, logos, contract
and licensing rights, rights of publicity or privacy, moral rights (i.e.,
“droit morale”), or any other intellectual property rights);
·
not
feature, refer to, or mention any companies or brands in competition with
Sponsor;
·
not
include any unauthorized photos, videos, essays, or plagiarism of any kind;
·
not
contain nudity, inappropriate, indecent, sexually explicit, pornographic, or
obscene content or images (which shall be determined by Sponsor, in its sole
and absolute discretion);
·
not
contain any political or politically themed or motivated messages, statements,
or images;
·
not
defame, slander, libel, misrepresent, or contain disparaging remarks or any
other content that could adversely affect the name, reputation, or goodwill of
Sponsor or any other individuals and/or entities affiliated or associated with
Sponsor, the Sweepstakes, or any prizes, the determination of which shall
remain in the sole discretion of Sponsor;
·
not
depict or include images that may be considered
unlawful, harmful, threatening, violent, abusive, harassing, tortuous,
defamatory, vulgar, libelous, invasive of another’s privacy, hateful, or
racially, religiously, ethnically or otherwise
objectionable in any manner as solely determined by Sponsor;
·
not
depict over consumption or irresponsible consumption of any product.
Representation and Release of Rights to Video
and/or Photo Content Submission: By submitting any entry, each Entrant
represents that s/he has sole and exclusive ownership and proprietary rights of
all submitted video and/or photo content (collectively, the “Submission
Content”) and the associated content submitted; has full permission of all
parties within the Submission Content to publish and release their images and
actions shown within the Submission Content; and agrees that each Submission
Content becomes the sole and exclusive property of Sponsor, and Sponsor may
publish, display, promote, advertised or utilize submitted content in any
manner of its choosing in relation to the promotion or advertising of the Sweepstakes
or Sponsor, including posting of the Entrant’s submitted content on Sponsor’s
website or any Social Media channel.
Entry into the Sweepstakes and upload of any Submission Content constitutes
permission for the Sponsor and its designees to use that Entrant’s Submission
Content, name, city and state of residence and/or likeness for purposes of
advertising and trade in any and all media now or hereafter known worldwide in
perpetuity without limitation or further compensation, notification or
permission, unless prohibited by law. Sponsor
and its designees shall have the unrestricted, perpetual, and royalty-free
right to use, reproduce, modify, publish, and display submitted content, in
whole or in part, on any products, merchandise, or packaging for commercial
purposes and the purpose of sale, without further compensation, notification,
or approval from the participant. Submission
Content entry submissions will not be acknowledged or returned by Sponsor.
Sponsor
may, in its sole discretion, display, feature, or repost any submitted content
in any media, including but not limited to Sponsor's websites, galleries, and
social media channels, during or after the Sweepstakes Period. The public
display or featuring of a submitted photo by Sponsor is for promotional,
marketing, or entertainment purposes only and does not constitute a
verification of eligibility, an indication of a winning entry, or a guarantee
that the entrant will be selected as a winner.
Sponsor reserves the right to
request from any Entrant, at any time, proof, in a form acceptable to Sponsor,
of any permission required or possibly required to use such Entrant’s Submission
Content included with entry. Failure to
provide such proof, if requested, may disqualify such Entry from the Sweepstakes.
Sponsor
reserves the right, in its sole discretion, to disqualify any individual (and
all of his or her entries) who tampers or attempts to tamper with or abuse the
entry process or the Sweepstakes website in any way or who is otherwise in
violation of these Official Rules, as determined by Sponsor or the Sweepstakes
judges appointed by Sponsor in their sole discretion. Any questions regarding the number of entries
submitted or the authorized account holder shall be determined by Sponsor in
its sole discretion. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY SWEEPSTAKES
WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A
VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE,
SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND SEEK DAMAGES FROM ANY SUCH PERSON
TO THE FULLEST EXTENT PERMITTED BY LAW.
Winner Selection and Notification (1 grand prize winner): A random
prize drawing will be held on or about 12/3/2026 from among
all eligible entries received to determine a maximum of one (1) potential grand
prize winner. If eligible entries are
less than the number of available prizes, then associated prizes shall not be
awarded.
The potential winner will be notified initially by phone
and/or email following their selection. If the Administrator is
unsuccessful in its attempt to reach and speak directly with the selected
potential prize winner by phone within 48-hours of the initial notification
attempt to the phone number or email address associated with that entrant’s
entry, then that entrant may be disqualified and an alternate potential winner
may be randomly selected from among the remaining eligible entries and notified
as per the procedures outlined above (time permitting).
During winner notification, the selected potential winner
must confirm their eligibility, and indicate their
willingness and ability to accept the applicable prize. The potential
winner will then receive official notification via mail or email
delivery. If the selected winner does not meet the eligibility
requirements, or is unable or unwilling to accept the prize or elects to
decline the prize, s/he will be disqualified and, at Sponsor’s discretion and
time permitting, an alternate winner will be randomly selected from among all
remaining eligible entries and notified as per the procedures outlined
above. Any disqualified entrant will not receive any alternate prize substitution or
compensation. Decisions of the Administrator in the selection and
determination of the winners and all matters relating to this
Sweepstakes are final and binding.
All of the following will apply to the winner: 1) Winner
will be required to complete and return, within 2-days of date of receipt, a
prize acceptance form, including an affidavit of eligibility and a
liability/publicity release (publicity release where permitted) and
a W-9 form (for prize values greater than $2,000); 2) Winner may be
required to present a copy of a valid social security card and a valid driver’s
license as a condition of receiving any prize; and 3) Winner will be
issued a 1099 and is solely responsible for paying all applicable taxes
(including, but not limited to all local, state and federal taxes) on all
prizes awarded.
Grand Prize Award (maximum 1 winner): The eligible
entrant designated as the grand prize winner shall receive a Zig-Zag Friend
Trip for the winner and up to a maximum of five (5) guests (age 21 or older). The grand prize has a maximum retail value not
to exceed $20,100, and shall include:

Roundtrip coach class airfare for the winner and up to five
(5) guests (age 21 or older) to the Sponsor designated airport nearest
St. Simon’s Island, GA (BQK, JAX, or SAV), as solely designated and
determined by Sponsor, subject to availability;
·
Dates of flights and departure/arrival airports are solely
designated and determined by Sponsor, subject to availability and black-out
dates.
·
If winner resides within 250-miles of the greater St. Simon’s
Island, GA area, Sponsor reserves the right to award one (1) $2,000 gift card
toward ground transportation in lieu of airfare.
·
Three (3) nights lodging accommodations
as solely designated and determined by Sponsor for the winner and up to a
maximum of five (5) guests (age 21 or older);
·
Prize award includes a maximum of three (3)
double-occupancy hotel rooms (two (2) people per room), subject to
availability; and Sponsor reserves the right to modify the hotel/lodging type based
on total number of confirmed travelers.
·
Location and dates of stay solely designated and determined
by Sponsor, subject to availability.
·
Sponsor reserves the right to award a prize check or gift
card toward the winner’s purchase of lodging accommodations in lieu of a confirmed
lodging reservation.
·
Bicycle rentals for the winner and each confirmed guest for
the duration of the trip (3-days);
·
One (1) meal for the winner and each confirmed guest
provided to the winner at their lodging accommodations, subject to
availability; and,
·
Private dining, restaurant, or catering as solely designated
and determined by Sponsor.
·
$3,000 awarded to the winner in the form of a gift card or
prize check toward ground transportation, incidentals, or additional activities.
·
Form of payment as solely designated
by Sponsor.
Travel
must be booked a minimum of four (4) weeks prior to initial date of travel and
must conclude by 5/31/2027. Actual grand prize
value based upon final travel accommodations, dependent on dates of travel, winner’s
home location, and number of confirmed guests of the winner. The grand prize winner and their guests must
be at least twenty-one (21) years of age and will be required to execute and
return a liability/publicity release prior to prize award. Any gift card provided as part of prize award
is subject to the terms and conditions of the gift card provider policy,
including any expiration. All ground
transportation including airport and hotel transfers, parking, meals,
gratuities, checked baggage fees, airline seat assignment fees, hotel resort
fees, incidental expenses, applicable taxes (including, but not limited to all
local, state and federal taxes) and any other expenses not specified herein as
being included in the prize award are the sole responsibility of the
winner. Sponsor is not responsible for
late, lost, damaged or stolen luggage.
It is recommended that winner and travel companion(s) obtain sufficient
personal insurance prior to departure.
The winner and travel companion(s) hereby release Sponsor from any duty
to provide, check, or verify any and all necessary
ID’s, passports, visas and tourist cards, birth certificates, vaccination
certificates, and any other travel requirements (“Personal Documents”). Sponsor shall not have any responsibility for
the replacement of lost or stolen Personal Documents or tickets, coupons,
vouchers, receipts or other documents pertaining to the prize (“Travel
Documents”) once the Travel Documents have been provided to each winner and
travel companion.
Sponsor
is not responsible for any travel delays, flight delays or cancellations or
travel difficulty related to prize award, redemption or use. If travel delays or difficulty prevent
arrival in time for any or all elements of trip or prize award, Sponsor is not
responsible for awarding any compensation in lieu thereof. Winner and his/her guest(s) must travel
together on the same itinerary. Any
changes to completed travel arrangements, once booked,
are the sole responsibility of the winner, and are solely at the winner’s
expense. Actual value of the trip will
depend on point of departure, destination and any airfare fluctuations. If actual value of prize is lower than the
stated maximum ARV of the prize award when it is procured and fulfilled, then
the difference will not be awarded to the winner. Airfare, lodging, and bike rental prize
components shall be prorated to the actual confirmed number of guest(s) and no additional compensation will be awarded to the
winner for unused portions of the prize award.
Winner and travel companion(s) are solely responsible for all costs
incurred to and from the nearest major airport to the winner’s home as
designated by Sponsor as the prize originates and terminates at such departure
point unless otherwise agreed to by Sponsor in writing.
Winner
and guest(s) shall be subject to any qualifying conditions prior to and during
travel, including any local, state or federal government regulations in the
departure or destination location, airline and/or hotel requirements, or
requirements including any regulation or policy related to COVID-19 testing
requirements or vaccination status. Any
testing requirements, vaccination and/or any related quarantine requirements
and expenses are the sole responsibility of, and at the sole expense of winner
and guest(s). Winner and guest(s) are
subject to vaccination requirement and policy, and if unable or unwilling to
comply with requirements, then all related prize award elements for which they
fail to meet shall be forfeit.
Sponsor
will not be responsible for any delay, rescheduling, postponement or
cancellation for any reason including but not limited to weather, pandemic, an
Act of God, Force Majeure, government regulation or restriction, an act of
terrorism, civil disturbance, work stoppage, or any other reason. No substitute prize award or compensation
shall be provided by Sponsor in the event of any travel delay, rescheduling,
postponement, or cancellation for any reason, and winner shall be subject to
the terms and conditions of the airline ticket, hotel, bike rental, or other
travel provider (collectively “Travel Providers”) policy and shall solely look
to the Travel Providers as applicable.
Winner
and guest(s) must be twenty-one (21) years old and agree to comply with all
applicable Travel Providers’ rules requirements, and
regulations in connection with the prize award, redemption, and use. Sponsor
and Travel Providers reserve the right to remove or deny entry to any winner
and/or his/her guest(s) who do not comply with any rule, requirement,
instruction, policy, or who engage in a disruptive manner, or with intent to
annoy, abuse, threaten, or harass any other person. Winner and guest(s) shall be solely
responsible for their behavior while traveling, and
must follow the instructions and direction from any Travel
Providers or associated staff or security.
If winner or guest(s) violates the standards of the Travel Providers,
behaves in an inappropriate, irresponsible or offensive manner, or is deemed by
staff or security to have violated any rule, regulation or policy of the Travel
Providers, or to be a security threat in any manner, the winner and guest(s)
shall be ejected or denied entry, and shall immediately forfeit the remaining
prize award.
Allow 8 – 12 weeks for gift card/prize check prize
delivery. Once shipped, prize shall be
considered as awarded and delivered, and Sponsor shall not be responsible for
actual receipt of delivery by winner.
Sponsor shall not be responsible for any lost, late, undelivered,
misdirected, damaged or stolen delivery; or any incorrect delivery address
provided by winner during registration or prize claim. In the event of any delivery issues,
including undelivered, misdirected, lost or stolen deliveries, Sponsor shall
have no responsibility to replace the prize award, and prize award shall not be
substituted by Sponsor with any alternate prize award or compensation. Winners shall look solely to
designated shipper/carrier for any lost, damaged, stolen or
mis-delivered packages and not to Sponsor for any
delivery issues.
General Prize Conditions: No
alcoholic beverage is part of any prize award. Prize
award may be delivered digitally, via mobile ticket transfer, or shipped to
winner’s residential address as provided at the time of entry and/or winner
notification via USPS or other Sponsor designated shipping/mail
carrier. Once delivered via digital or mobile transfer or shipped,
the prize shall be considered awarded, delivered and fulfilled, and Sponsor
shall have no responsibility for any shipment that is delayed, damaged, lost,
misdelivered, undelivered or stolen, or any incorrect mobile number, email or
shipping address provided by winner. In the event of any delivery
issues, prize award shall not be replaced or substituted with any alternate
prize award or compensation. Winner shall look solely to shipping carrier for any lost, damaged, misdelivered,
undelivered, stolen or delayed shipment.
Maximum total ARV of all available prizes: $20,100.
All other costs and expenses related to prize acceptance,
delivery, redemption or use not specified herein as being provided are the sole
responsibility of winner. All income, federal, state and local taxes
are the winner’s sole responsibility. All prizes are awarded as is,
without any warranty, express or implied, by Sponsor. All prize
awards are non-transferable and no cash redemption or prize substitution
allowed, except at Sponsor’s sole discretion or as provided
herein. Sponsor reserves the right to substitute a prize with one
(1) of comparable or greater value, at its sole discretion. Failure
to collect or properly claim prize in accordance with these Official Rules will
result in forfeiture of the prize. If forfeited for any reason,
entrant will not receive any other prize substitution or compensation, and
the prize will remain the property of Sponsor and will not be awarded, except
as provided herein. All properly claimed prizes will be
awarded. Any unclaimed prizes will not be awarded.
Additional Rules & Restrictions: By participating, entrants
agree to abide by and be bound by the Official Rules and the decisions of the
Sponsor and Administrator, which shall be final in all matters relating to this
Sweepstakes. In the event an entrant wins a prize,
and is later found to be in violation of these rules he/she will be
required to forfeit the prize or to reimburse Sponsor for the stated value of
the prize if such violation is discovered after winner has used the prize.
Participation in Sweepstakes constitutes permission for the Sponsor, the
Released Parties and their designees to use entrants’ names, likenesses,
images, biographical information, and cities and states of residence for
purposes of advertising and trade in any and all media now or hereafter known
worldwide on perpetuity without limitation or further compensation,
notification or permission, unless prohibited by law. False,
fraudulent or deceptive entries or acts shall render entrants
ineligible for any prize.
By participating, entrants agree to hold all Released
Parties harmless from any claims, losses, actions, or damages of any kind,
whether actual, incidental or consequential, for injury (including but not
limited to death), damages, losses or expenses arising out of or relating to
entrant’s participation in this Sweepstakes, or the acceptance, possession or
use/misuse of any prize, or participation in prize-related activities
(including but not limited to travel or activity related thereto), and to assume
all liability therefor.
Released Parties shall not be liable to winner or any other
person for failure to supply the prize or any part thereof by reason of any
acts of God, any actions, regulations, orders, or requests by any governmental
entity, equipment failure, terrorist acts, war, fire, unusually severe weather,
embargo, labor dispute or strike, labor or material shortage, transportation
interruption of any kind, or any other cause beyond Released Parties’ sole
control.
Participants are restricted to use of
ordinary and typical computer equipment, mobile phone equipment, Internet
access and cellular networks. Sponsor disclaims all liability for the inability
of a participant to complete or continue an entry due to equipment malfunction,
busy lines, inadvertent disconnections, acts beyond the Sponsor’s control, or
otherwise. The Sponsor disclaims any liability for entries not received due to
technical difficulties or transmission errors. The Sponsor disclaims all
liability for any delays, mis-delivery, loss, or failure in the delivery of any
item sent by mail, courier, express, electronic transmission, or other delivery
method. Released Parties are not responsible for mechanical,
technical, electronic, communications, telephone, computer, hardware or
software errors, malfunctions or failures of any kind, including: failed,
incomplete, garbled or delayed transmission of online entries, traffic
congestion on telephone lines, the Internet or at any website or lost or
unavailable network connections which may limit an online entrant's ability to
participate in the Sweepstakes, and any injury or damage to entrant’s or any
other person’s computer or mobile phone related to or resulting from
participating in or downloading any information necessary to participate in the
Sweepstakes. Released Parties are not responsible for any other
errors of any kind, whether computer, technical, typographical, printing, human
or otherwise, relating to or in connection with the Sweepstakes, including,
without limitations, errors which may occur in connection with the printing or
advertising of this Sweepstakes, administration or execution of the
Sweepstakes, the cancellation of the game, the processing of entries or in the
announcement of the prizes or prize winners. Sponsor, in its sole
discretion, reserves the right to disqualify any person tampering with the
entry process or the operation of the Sweepstakes website.
Sponsor reserves the right to cancel, modify, reschedule or
terminate the Sweepstakes for any reason including, but not limited to acts of
God, pandemics, force majeure, government regulatory action or
ruling, fraud, misconduct, or if any technical failures destroy or
threaten the integrity of the Sweepstakes, in the opinion of the
Sponsor/Administrator, or if a computer virus, bug, or other technical problem
corrupts the administration, security, or proper conduct of the Sweepstakes as
determined by Sponsor/Administrator, in their sole discretion. In the event of
early termination of the Sweepstakes, Sponsor reserves the right to determine
prize winners in a random drawing from among all eligible, non-suspect entries
received as of the time/date of such termination.
IN CASE OF DISPUTES: By
participating, each entrant agrees that (1) any and all disputes, claims, and
causes of action arising out of or in connection with this Sweepstakes, or any
prizes awarded, shall be resolved individually, without resort to any form of
class action, and any judicial proceeding shall take place in a federal or
state court within the State of New Jersey; (2) any and all claims, judgments,
and awards shall be limited to actual out-of-pocket costs incurred, including
costs associated with entering this Sweepstakes, and in no event will entrant
be entitled to received attorneys' fees or other legal costs; and (3) under no
circumstances will entrant be permitted to obtain awards for, and entrant
hereby waives all rights to claim, punitive, incidental, and consequential
damages, and any other damages, other than for actual out-of-pocket expenses,
and any and all rights to have damages multiplied or otherwise increased. All
issues and questions concerning the construction, validity, interpretation and
enforceability of these Official Rules, or the rights and obligations of
entrant and Sponsor in connection with this Sweepstakes, shall be governed by,
and construed in accordance with the laws of the State of New Jersey, without
giving effect to any choice of law or conflict of law rules or provisions
(whether of the State of New Jersey or any other jurisdiction), that would cause
the application of the laws of any jurisdiction other than the State of New
Jersey.
Odds: Odds of being selected as the prize winner
are dependent upon the total number of eligible entries received.
